Winn, as Commissioncr of Education, files this Administrative Complaint against SUSAN A, HEDGER. The Petitioner seeks the appropriate disciplinary sanction of the Respondent’s educator’s certificate pursuant to Sections 1012.795 and 1012.796, Florida Statutes, and pursuant to Rule 6B- 1.006, Florida Administrative Code, Principles of Professional Conduct for the Education Profession in Florida, said sanctions specifically set forth in Sections 1012.795(1) and 1012.796(7), Florida Statutes. ‘The Petitioner alleges: JURISDICTION 1. The Respondent holds Florida Educator’s Certificate 755962, covering the areas of General Science and Social Science, which is valid through June 30, 2007. 2. At all times pertinent hereto, the Respondent was employed as a Teacher at Largo Middle School in the Pinellas County School District. MATERIAL ALLEGATIONS 3. Belween August 2002 and September 2003, school officials formally met with and counseled Respondent approximately 20 times concerning her interactions with students, parents and staff, as well as following various school or schoo! board policies. On or about October 8, 2003, Respondent's principal issued her a letter of reprimand for disparaging and other inappropriate remarks to or about students and staff and for insubordination regarding four separate incidents, including throwing a backpack at a student and hitting her with it. SUSAN A, HEDGER Administrative Complaint Page 2 of 3 4, During March 2004, Respondent knowingly and unlawfully violated standardized testing procedures during the administration of the Florida Comprchensive Assessment Test (FCAT). Respondent failed to read to the students the instructions for the test as required and failed to collect iest materials prior to breaks. School board officials issucd Respondent a letter of reprimand for this conduct. 5, During March and April 2004, Respondent made numerous inappropriate comments to or about students. The comments included profanity, discipline issues concerning students, and comments or discussions of a sexual nature, On or about May 25, 2004, Respondent entered into an agcecment with the school beard in which she accepted a 3 day suspension without pay for this conduct. STATUTE VIOLATIONS COUNT 1: The Respondent is in violation of Section 1012,795(1)(c), Florida Statutes, in that Respondent has been guilty of gross immorality or an act involving moral turpitude. COUNT 2: The Respondents in violation of Section 1012.795(1)(i), Florida Statutes, in that Respondent has violated the Principles of Professional Conduct for the Education Profession prescribed by State Board of Education rules. RULE VIOLATIONS COUNT 3: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(3)(a), Florida Administrative Code, in that Respondent has failed to make reasonable effort to protect the student from conditions harmful to learning and/or to the student’s mental health and/or physical health and/or safety. COUNT 4; — The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(3)(c), Florida Administrative Code, in that Respondent has intentionally exposed a student to unnecessary cmbarrassment or disparagement, COUNT 5: = The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(3)(i), Florida Administrative Code, in that Respondent has failed to keep in confidence personally identifiable information obtained in the course of professional services, unless disclosure serves professional purposes or is required by law. HEDGER Administrative Complaint Page 3 of 3 WHEREFORE, the Petitioner recommends that the Education Practices Commission impose an appropriate penalty pursuant to the authority provided in Sections 1012.795(1) and 1012.796(7), Florida Statutes, which penalty may include a reprimand, probation, restriction of the authorized scope of practice, administrative line, suspension of the teaching certificate not to exceed three years, permanent revocation of the teaching ccrtificate, or combination thereof, for the reasons set forth herein, and in accordance with the Explanation and Election of Rights forms which are attached hereto and made a part hereof by reference. a EXECUTED on this \__ dayof_ Jwone , 2005, JOHN L.
