Department of Business and Professional Responsibility this Administrative Complaint agains Respondents, Daniel J. Rich, aid alleges: : 1. The Board of Professional Engineers is charged with deterring the unlicensed practice of engineering pursuant to Section 471.038(5) and Chapter 455, Florida Statutes, 2, Respondent’s last known address is 4155 Sable Chase Drive, Houston Texas 77014, 3. Respondent obtained a license, number 55625, to provide engineéking services in the State of Florida‘in February 23, 2000. : 4, Respondent voluntarily placed his license on inactive status on Shnuary 6, 2003, and it remained on inactive status until’ December 1, 2005, at which time Resporident’s licensure status was changed from inactive to active based on Respondent’s compliance vith the Board’s continuing education requirements. | 4 [ 4 Jan 12 2007 16:08 Fax sent by : 9585218521 FL BOARD 41-12-87 17:48 Pg: 4/45 6 6 5. On or about December 21, 2004, Respondent approached Keneth Revell of Santa Rosa, Florida at Reveli’s hurricane damaged house and represented himsel to Revell to be a civil engineer representing Reveli’s homeowner’s insurance company, Respondent conducted a physical inspection of the damage to Revell’s home on that date and again on or about December 23, 2004. On or about January 6, 2005, Respondent further represented to Res {1 that he had. prepared an “engineet’s report” on the damage but would not release it until he ‘was licensed in 1 Florida, 6. Based on the foregoing, Respondent violated Section 471.0380X6), Florida Statutes, by practicing engineering on an inactive license. WHEREFORE, the Petitioner respectfully requests the Board of Professjonal Enginégers to enter an order. imposing one or more of the following penalties: permanent revocation or suspension of the Respondent’s license, restriction of the Respondent’s practice, imposition of an administrative fine, issuance of a reprimand, placement of the Respondent or probation, the assessment of costs related to the investigation and prosecution of this case, dther than costs associated ‘with an attomey’s time, as provided for in Section 455.227(3), Florida: Keanutes, and/or any other relief that the Board deems appropriate.
