State of Florida, Department of Business and Professional Regulation, Division of Real Estate (“Petitioner”) files this Administrative Complaint against Carlos Enrique Schol ' (“Respondent”) and alleges: ESSENTIAL ALLEGATIONS OF MATERIAL FACT 1. Petitioner is a state government licensing and regulatory agency charged with the responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State of Florida, in particular Section 20.165 and Chapters 120, 455 and 475 of the Florida Statutes, and the tules promulgated pursuant thereto. | 2. Respondent is and was at all times material hereto a licensed Florida real estate sales associate, issued license number 3014239 in accordance with Chapter 475 of the Florida Statutes. 3. The last license issued was as an active sales associate at Independent Brokers Realty, Inc., 1639 Cape Coral Parkway #208, Cape Coral, Florida 33904.. FDBPR vs Carlos E. Schol FDBPR Case N° 2002010495 Administrative Complaint 4. On or about August 13, 2002, Respondent’s teal estate license was transferred from Real Estate Corporation of America, (“REC”) to Independent Brokers Realty (“IBR”). 5. On or about July 29, 2002, Respondent facilitated a residential sales and purchase contract between Cape Coral American Land and Shirley A. Lynott for residential property commonly known as 812 Sw. 7" Terrace, Cape Coral, Florida, 33991. A copy of the contract is attached hereto and incorporated herein as Exhibit 1. 6, On the sales and purchase contract, Respondent indicated that he was licensed with “TBR.” 7. At all times material, Respondent’s license was not with IBR. COUNT I Based upon the foregoing, Respondent is guilty of fraud, misrepresentation, concealment, false promises, false pretenses, dishonest dealing by trick, scheme or device, culpable negligence, or breach of trust in any business transaction in violation of Section 475.25 (1)(b), Florida Statutes. COUNTI ~. Based upon the foregoing, Respondent is guilty of having operated as a broker while licensed as a sales associate in violation of Section 475.42(1)(b), Florida Statutes and, therefore, in violation of —————__ Section 475,25(1)(e), Florida Statutes. COUNT Ir Based upon the foregoing, Respondent is guilty of making misleading, deceptive, or fraudulent representations in or related to the practice of the licensee’s profession in violation of Section 2 FDBPR vs Carlos E. COUNT IV Based upon the foregoing, Respondent is guilty of failing to perform any statutory or legal obligation placed upon a licensee in violation of Section 455.227(1)(k), Florida Statutes. COUNT V Based upon the foregoing, Respondent is guilty of making deceptive, untrue, or fraudulent representations in or related to the practice of a profession or employing a trick or scheme in or related to the practice of a profession in violation of Section 455.227(1)(m), Florida Statutes. COUNT VI Based upon the foregoing, Respondent is guilty of practicing or offering to practice beyond the scope permitted by law or accepting and performing professional responsibilities the licensee knows, or has reason to know, the licensee is not competent to perform in violation of Section 455.227(1)(0), FURTHER ESSENTIAL ALLEGATIONS OF MATERIAL FACT | 8. Petitioner realléges and incorporated herein Paragraphs One through Three. 9. On or about December 13, 2002, Respondent told Petitioner’s investigator that Respondent did not place his name or employer on the contract for the property commonly known. as 812 SW. 7" Terrace, Cape Coral, Florida, 33991. A copy of the contract is attached hereto and incorporated herein as Exhibit 2. 10. On the sales and purchase contract Respondent indicated that he was licensed with FDBPR ys Carlos E. COUNT VIL Based upon the foregoing, Respondent is guilty of having obstructed or hindered in any manner the enforcement of Chapter 475, Florida Statutes or the performance of any lawful duty by any person acting under the authority of Chapter 475, Florida Statutes in violation of Section 475.42(1)(), Florida Statutes and, therefore, in violation of Section 475.25(1)(e), Florida Statutes. COUNT VII Based upon the foregoing, Respondent is guilty of knowingly concealing any information relating to violations of Chapter 475, Florida Statutes, in violation of Section 475.42(1)(1), Florida Statutes and, therefore, in violation of Section 475.25(1)(e), Florida Statutes. | COUNT IX Based upon the foregoing, Respondent is guilty of making deceptive, untrue, or fraudulent representations in or related to the practice of a profession or employing a trick ot scheme in:or related. to the practice of a profession in violation of Section 455.227(1)(m), Florida Statutes. FURTHER ESSENTIAL ALLEGATIONS OF MATERIAL FACT 11. Petitioner realleges and incorporated herein Paragraphs One through Three above. 12. On or about August 12, 2002, Respondent facilitated a residential sales and purchase agreement between for property commonly known as 2715 SW. 25" terrace, Unit #93, Cape Coral, Florida, 33914. 13. At all times material, Respondent’s license was not with IBR. COUNT X . .. Based upon the foregoing, Respondent is guilty of fraud, misrepresentation, concealment, false promises, false pretenses, dishonest dealing by trick, scheme.or device, culpable negligence, or breach of trust in any business transaction in violation of Section 475.25(1)(b), Florida Statutes. COUNT XII Based upon the foregoing, Respondent is guilty of failing to perform any statutory or legal obligation-placed upon a licensee in violation of Section 455.227(1)(k), Florida Statutes. COUNT XV | Based upon the foregoing, Respondent is guilty of practicing or offering to practice beyond the scope permitted by law or accepting and performing professional responsibilities the licensee knows, or has reason to know, the licensee is not competent to perform in violation of Section 455.227(1)(0), WHEREFORE, Petitioner respectfully requests the Florida Real Estate Commission, or the Department of Business and Professional Regulation, as may be appropriate, to issue-a Final Order as final agency action finding the Respondent(s) guilty as charged. The penalties which may be imposed for violation(s) of Chapter 475 of the Florida Statutes, depending upon the severity of the offense(s), include: revocation of the license or registration or permit; suspension of the license, registration or permit for a period not to exceed ten (10) years, imposition of an administrative fine of up to $1,000 for each count or offense; imposition of investigative costs; issuance of a reprimand; imposition of probation subject to terms including, but not limited to, requiring’ the licensee, registrant or permitee to complete and pass additional real estate education courses; publication; or - any combination of the foregoing which may apply.
