The Commigsion seeks to impose disciplinary action upon tha referenced individual based on the following allegations: 1. . Respondent was certified by the Criminal Justice Standards and Training Commission on March 3, 2004, and was issued Corrections Certificate Number 238513. 2. On or between October 14, 2001 and June 27, 2003, the Respondent, Paméla Branch, did knowingly fail, by false statement, misrapresentation, impersonation, or other fraudulent means, to disclose a material fact used in making a determination as to the person’s qualification to receive aid or benefits under a state or federally funded assistance program, to-wit: Florida Kid Care and thereby wrongfully received, retained, misappropriated, | sought or used assistance of an aggregate value of two hundred dollars ($200.00) or more for 12 gensecutive months beginning on or about November 1, 200] and ending on or about July 31, 2003. The actions of the Respondent did violate the provisions of Section 414.39(1), Florida Statutes ox any lesser included offenses, Section 943.1395(6) and/or (7), Flexida Statutes, and/or Rule 11B-27.0011(4)a, Florida Administrative Code, in that Respondent has failed to maintain the qualifications established in Section 943.137), Florida Statutes, which require that a Correctional Officer in the State ef Florida have good moral chamactér,. 4, This Administrative Complaint is issued pursuant to Sections 120.60, and 943,.1395(6) and/or (7), Florida Statutes. Any proceedings concerning thie Complaint shall be conducted pursuant to Sections 120.569 and 120.57, Florida Statutes, and Rules 118-27, 28+106, and 28-107, Florida ‘Adminiatrative ‘Code. Mediation is not available under Section 120.573, Florida Statutes. WHEREFORE, itt is alleged that the Respondent, Pamela Branch is guilty of violating Sections 943.1395(6) and/or (7), and/or 943,13(7), Florida Statutes, and/or Rule 118-27.0011(4)a, Florida Administrative Code.
