WINN, as OIVISION OF Commissioner of Education, ADMIRISTRATIVE HEARINGS Petitioner, vs. CASE NO. 034-2822-D WILLIAM JAYSON DUBOIS, Respondent, / ADMINISTRATIVE COMPLAINT Petitioner, John L. Winn, as Commissioner of Education, files this Administrative Complaint against WILLIAM JAYSON DUBOIS, The Petitioner seeks the appropriate disviplinary sanction of the Respondent’s educator's certificate pursuant to Sections 1012.795 and 1U12.796, Florida Statutes, and pursuant to Rule 6B-1,006, Florida Administrative Code, Principles of Professional Conduct for the Education Profession in Florida, said sanctions specifically set forth in Sections 1012,795(1) and 1012.796(7), Florida Statutes. The Petitioner alleges: JURISDICTION 1, The Respondent holds Florida Educator's Certificate 943982, covcring the area of Music, which is valid through June 30, 2009- 2, At all times pertinent hereto, Respondent held an intern position as a teacher at Winter Haven High School, and was employed as a substitute teacher at Haines City High School in the Polk County School District. MATERIAL ALLEGATIONS 3 During 2004, Respondent engaged in an inappropriate relationship with K.H., a 15- year-old female student, including, but not limited to, visiting her in her home and indicating to others that they were in love, or words to thal effect. On or about April 14, 2004, Respondent resigned in licu of termination. 4, On his application for a Florida Educator's Certificate dated May 20, 2004, Respondent purposefully failed to disclose his previous teaching experience in the Polk County WILLIAM JAYSON DUBOIS Adniinistrative Complaint Page 2 of 3 School District, and purposefully failed to disclose the fact that he had resigned or that his previous employer had reported him to the Bureau of Professional Practices Services for investigation. STATUTE VIQLATIONS COUNT 1: The Respondent is in violation of Scctian 1012.795(1)(a), Florida Statutes, in that Respondent obtained the teaching certificate by fraudulent means. COUNT 2: The Respondent is in violation of Section !012.795(1)(c), Florida Statutes, in that Respondent has been guiity of gross immorality or an act involving moral turpitude. COUNT 3: The Respondent is in violation of Section 1012.795(1)(£), Florida Statutes, in that Respondent has been found guilty of personal conduct which seriously reduces his effectiveness as an employee of the school hoard. COUNT 4: — The Respondentis in violation of Seclion 1012.795(1)(i), Florida Statutes, in that Respondent has violated the Principles of Professional Conduct or the Education Profession prescribed by State Board of Education rules, RULE VIOLATIONS COUNT 5: = The allegations of misconduct set forth herein are in violation of Rule 6B- 1,006(3)(a), Florida Administrative Code, in that Respondent has failed to make reasonable effort to protect the student from conditions harmful to learning and/or lo the student’s mental health and/or physical health and/or safety, COUNT 6: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(3)(h), Florida Administrative Code, in that Respondent has exploited a relationship with a student for personal gain or advantage. COUNT 7: — The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(5)(a), Florida Administrative Code, in that Respondent has failed to maintain honesty in all professional dealings. COUNTS; The Respondentis in violation of Rule 6B, 1006(5)(g), Florida Administrative Code, in that Respondent has misrepresented one's own professional qualilications. COUNT9: — The Respondentis in violation of Rule 6B.1006(5)(h), Florida Administrative Code, in that Respondent has submitted fraudulent information on a document in conncction with professional activilics. WILLIAM JAYSON DUBOIS Administrative Complaint Page 3 of 3 WHEREFORE, based on the reasons set forth hercin and in accordance with the Explanation of Rights and Election of Rights forms attached to and made a part of' this Administrative Complaint, Petitioner respectfully recommonds that the Education Practices Commission impose an appropriate sanction against the Respondents educator’ s certificate pursuant to the authority provided in Sections 1012.795(1) and 1012,796(7), Florida Statutes. The sanctions imposed by the Education Practices Commission may include, but are not timited to, any one ora combination of the following: issuing the Respondent a written reprimand; placing the Respondent on probation for any period of time; restricting the Respondent’s authorized scope of practice: assessing the Respondent an administrative tine; directing the Respondent to enroll in the Recovery Network Program; suspending the Respondent’s educator’s certificate for a period of time not to excecd five ycurs; revoking the Respondent's educator's certificate for a periad of time up to 10 years or permanently; or barring the Respondent from reapplying for an educator's certificate for a period of time up to 10 years or permanently.
