ADMINISTRATIVE COMPLAINT
Petitioner, John L. Winn, as Commissioner of Education, files this Administrative
Complaint against JULIA D. SHETTLEWOOD. The Petitioner seeks the appropriate
disciplinary sanction of the Respondent's educator's certificate pursuant to Sections
1012.795 and 1012.796, Florida Statutes, and pursuant to Rule 6B-1006, Florida
Administrative Codec, Principles of Professional Conduct for the Education Profession in
Florida, said sanctions specifically set forth in Sections 1012.795(1) and 1012.796(7),
Florida Statutcs.
The Petitioner alleges:
JURISDICTION
1. The Respondent holds Florida educator's ccrtilicate 824056, covering the
area of Elcmentary Education which is valid through June 30, 2009.
2. At all times pertinent hereto, the Respondent was employed as a Teacher
at Greenglade Elementary School in the Miami-Dade County School District.
ALLEGATION
3. On or about October 10, 2003, the Respondent’s professional performance
was observed and evaluated as a part of her annual evaluation. Based upon this
observation, the Respondent was found to be unsatisfactory in twelve areas: time
management, managing engagement in learning, initial motivation to learn, teaching
methods and learning tasks, resources for learning, knowledge of content and pedagogy,
clarification of content/Icarning tasks, highcr order cognition, problem solving and

creative thinking, monitoring engagement and/or involvement in learning, informal
assessment and feedback.
4, On or about November 13, 2003, the Respondent’s professional
performance was again observed and evaluated as a part of her annual evaluation. Based
upon this observation, the Respondent was found to be unsatisfactory in sixteen areas:
time management, learning routines, managing engagement in learning, monitoring and
maintaining learner behavior, interpersonal relations, initial motivation to learn, tcaching
methods and learning tasks, resources for learning, knowledge of content and pedagogy,
clarification of content/leaming tasks, higher order cognition, questioning strategies,
problem solving and creative thinking, monitoring engagement and/or involvement in
learning, informal assessment and feedback.
5, On or about January 8, 2004, the Respondent’s professional performance
was observed and evaluated as a part of her annual evaluation. Based upon this
observation, the Respondent was found to be unsatisfactory in sixteen areas: time
management, managing engagcment in learning, monitoring and maintaining learner
behavior, interpersonal relations, learning equity, initial motivation to learn, teaching
methods and learning tasks, resources for learning, knowledge of content and pedagogy,
clarification of contenvlearning tasks, higher order cognition, questioning strategics,
problem solving and creative thinking, monitoring engagement and/or involvement in
learning, informal assessment and feedback.
6. On or about February 10, 2004, the Respondent’s professional
performance was again observed and evaluated as a part of her annual evaluation. Based
upon this observation, the Respondent was found to be unsatisfactory in fifteen areas:
time management, lcarning routines, managing engagement in learning, monitoring and
maintaining learner behavior, initial motivation to learn, teaching methods and learning
tasks, resources for learning, knowledge of content and pedagogy, clarification of
content/learning tasks, higher order cognition, questioning strategies, problem solving
and creative thinking, monitoring engagement and/or involvement in learning, informal
assessment and feedback.
7. Despite ample time and assistance provided by the school district for
remediation and improvement, the Respondent’s professional performance remained
unsatisfactory, and as a result she was recommended for termination. She subsequently
resigned from her position of employment with the school district.

STATUTE VIOLATION
COUNT 1, ‘The allegations of misconduct set forth herein are in violation of
Section 1012.795(1)(b), Florida Statutes, in that Respondent has proved to be
incompetent to teach or to perform duties as an employee of the public school system or
to teach in or to operate a private school.
WHEREFORE, the Petitioner recommends that the Education Practices
Commission impose an appropriate penalty pursuant to the authority provided in Sections
1012.795(1) and 1012.796(7), Florida Statutes, which penalty may include a reprimand,
probation, restriction of the authorized scope of practice, administrative fine, suspension
of the teaching certificate not to exceed three years, permanent revocation of the teaching
certificate, or combination thereof, for the reasons set forth herein, and in accordance
with the Explanation and Election of Rights forms which are attached hereto and made a
part hereof by reference.
