CASE NO. 2005-00720 JOSE CRESPIN, M.D., RESPONDENT. / ADMINISTRATIVE COMPLAINT COMES NOW Petitioner, Department of Health, by and through its undersigned counsel, and files this Administrative Complaint before the Board of Medicine against Respondent, Jose Crespin, M.D,, and in support thereof alleges: 1. Petitioner is the state department charged with regulating the practice of medicine pursuant to Section 20.43, Florida Statutes; Chapter 456, Florida Statutes; and Chapter 458, Florida Statutes. 2. At all times material to this Complaint, Respondent was a licensed physician within the State of Florida, having been issued license number ME 60672. cuz + AUN Aug 7 200° 9:20 fug 7 2007 9:18 P.03 Ne wd 3. Respondent's address of record is 9048: Harding Avenue, Miami Beach, Florida 33154. 4. On or about December 11, 2003, the Florida Board of Medicine (“Board”) entered a Final Order (“Order”) in case number 2002-22897, which required Respondent among other things, to complete six (6) hours of Continuing medical education (“CME”) on Internet Prescribing, six (6) hours of. CME on Risk Management, four (4) hours of CME on Pharmaceuticals, two (2) hours of CME on Ethics and fifty (50) hours: of Community Service. The Respondent was required to perform the community service and complete the CME hours and submit the documentation of completion within one year of the date the Order was filed. The Order was filed on December 11, 2003 and the CME documentation and the compliance with community service requirement were due on December 10, 2004, 5. As of July 8, 2005, Respondent failed to comply with the completion and documentation of six (6) hours of CME on Internet Prescribing, six (6) hours of CME on Risk Management, four (4) hours of CME on Pharmaceuticals, two (2) hours of CME on Ethics and failed to perform fifty (50) hours of Community Service as ordered by the Board. Section 458.331(1)(x), Florida Statutes (2004), provides that ) Violating a lawful order of the board or department previously entered in a disciplinary hearing or failing to comply with a lawfully issued subpoena of the department constitutes grounds for discipline by the Board of Medicine. 7. Respondent failed to complete and submit the documentation of completion of six (6) hours of CME on Internet Prescribing, six (6) hours of CME on Risk Management, four (4) hours of CME on Pharmaceuticals, two (2) hours of CME on Ethics and Respondent failed to perform fifty (50) hours of Community Service as ordered by the Board. 8. Based on the foregoing, Respondent has violated Section 458.331(1)(x), Florida Statutes (2004), by violating a lawful order of the Board previously entered in a disciplinary hearing. WHEREFORE, Petitioner respectfully requests that the Board of Medicine enter an order imposing one or more of the following penalties: permanent revocation or suspension of Respondent's license, restriction of practice, imposition of an administrative fine, issuance of a reprimand, placement of the Respondent on probation, corrective action, refund of fees billed or collected, remedial education and/or any other relief that the Board deems appropriate. NOTICE REGARDING ASSESSMENT OF COSTS Respondent is placed on notice that Petitioner has incurred costs related to the investigation and prosecution of this matter. Pursuant to Section 456.072(4), Florida Statutes, the Board shall assess costs related to the investigation and prosecution of a disciplinary matter, which may include attorney hours and costs, on the Respondent in addition to any other discipline imposed.
