(a) On or about May 3, 2004, the Respondent, John Bandorf, did unlawfully and intentionally commit an assault upon Scett David Ferenaz, by threatening by word er act te do violence to said person, coupled with an apparent ability to do so, and by doing an act which created a well-founded fear in said Scott David Ferenoz that said violence was imminent, by unlawfully and intentionally striking the 1996 4 door Jeep of Scott David Ferencz, causing damage with a’ deadly weapon, to-wit: a 1997 Ford van. (c) On or about May 3, 2004, the Respondent, John Bandor£, did unlawfully and willfully flee or attempt to elude Michal Coomans, haw enforcement officer and others, in authorized law enforcement patrol vehicles of the Holly Hill Police Department, with Agency insignia and other | jurdisdietional markings prominently displayed on the vehicles, with siren and lights activated and during the course of the fleeing or attempted eluding did drive in a manner which demonstrated a wanton disregard for the safety of persons or property. 3.
