Case No. 2006-060435 WILLIAM W. GOODE, D/B/A FLORIDA RESTORATION TEAM, Respondent. ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, ("Petitioner"), files this Administrative Complaint before the Construction Industry Licensing Board, against WILLIAM W. GOODE, d/b/a FLORIDA’ RESTORATION TEAM ("Respondent"), and says: 1. Petitioner is the state agency charged with regulating the practice of contracting pursuant to section 20.165, Florida Statutes, and Chapters 455 and 489, Florida Statutes. 2, Respondent is, and has been at all times material hereto, a Certified General Contractor, in the State of Florida, having been issued license number CG C014847, which is on probation. 3. Respondent's address of record is 4725 North Hesperides Street, Tampa, Florida, 33614, 4. At all times material hereto, Respondent was the qualifying agent for Florida Restoration Team, which was issued certificate of authority QB 14580, which is current and Aug 23 2007 14:33 ga/2a/28e7 14:17 8589219186 DEPR PAGE @4/a7 5, As a result of Department of Business and Professional Regulation case number 2000-03280, Respondent was placed on a three-year probation period and was required during that time to make satisfactory appearances before the Construction Industry Licensing Board. The Board was to determine what constituted “satisfactory.” 6. A complaint from the Construction Industry Licensing Board states that on September 14, 2006, Respondent appeared before the Probation Committee, with the result that Respondent bad his fourth unsatisfactory appearance due to his failure to provide all pages of his bank account statements. COUNT I 7. - Petitioner realleges and sets forth the allegations in paragraphs | through 6 as though fully set forth herein. ! 8. Section 489.189(1)(i), Florida Statutes, states that the board may take action against a registrant for “failing in any material respect to comply with the provisions of this part or violating a rule or lawful order of the board.” 9. Based on the foregoing, Respondent violated section 489.129(1)(i), Florida Statutes, by failing in any material respect to comply with the provisions of Chapter 489, Part I, Florida Statutes, or violating a rule or lawful order of the board, by having violated section 489.1425(1), Florida Statutes. COUNT TH 10. Petitioner realleges and sets forth the allegations in paragraphs 1 through 6 as though fully set forth herein. 11. Based on the foregoing, Respondent violated Section 489.129(1)(m), Florida Statutes, by committing incompetency or misconduct in the practice of contracting. Aug 23 2007 14:33 ga/2a/28e7 14:17 8589219186 DEPR PAGE 85/87 WHEREFORE, Petitioner respectfully requests the Construction Industry Licensing Board enter an Order imposing one or more of the following penalties: place on probation, reprimand the licensee, revoke, suspend, deny the issuance or renewal of the certificate of registration, tequire financial restitution to a consumer, impose an administrative fine not to exceed $5,000.00 per violation, require continuing education, assess costs associated with the investigation and prosecution, impose any or all penalties delineated within Section 455.227(2), Fiorida Statutes, and/or any other relief the Board is authorized to impose pursuant to Chapter 455 and 489, Florida Statutes, and the rules promulgated thereunder.
