Design against SYNERGY, LLC, ("Respondent"), and ‘says: 1. : Petitioner i is the state agency charged with regulating the practice of architecture pursuant to Section 20. 165, Florida Statutes, and Chapters 455 and 4gi, Florida. Statutes. 2. Respondent was previously a ‘licensed architectural firm in the State of Florida, having been issued license number AA 3604, 3. Respondent's address of record is 1600 26 Street, Suite 10, Vero Beach, Florida 32960. | | -.4. Section 481.219(2), Florida Statutes, requires a certificate of authorization to practice architectural services through a corporation, partnership, or under a fictitious name. 5: . As of March 1, 2005, Resporident’s certificate of authorization was placed in a - delinquent status for failing to renew. 6. On or about January 31, 2007, Respondent prepared architectural. drawings fora commercial project known as American Business Park Condo. 7. Respondent no longer holds-an active certificate of authorization and therefore cannot provide architectural drawings fora commercial proj ect. 8. Respondent no longer employs a licensed architect nor has a principal officer of the corporation that is a licensed architect. 9. : Respondent cannot continue to offer architectural services without a licensed - architect qualifying the firm. . | COUNT I 10. ‘Petitioner heveby zealleges and incorporates paragraphs one (1) through nine (9) as if fully set forth herein. i . . 11. ‘Section 481. ri9c7ye), 1 Florida Statutes, sates that the board shall esrty 2 an. , spplicant as qualified for a certificate of authorization to. offer atchitectural services provided | that one or more of the principal officers of the corporation a are registered architects. 12. Based upon the foregoing, Respondent has violated Section 481.219(7)(a), Florida Statutes, by practicing architectural services through a corporation without a registered architect _ acting as a principal officer.of the corporation. a - . COUNT COUNT I. 13. Petitioner hereby realleges and: incorporates paragraphs o one (1) through: nine. © (9) as if fully set forth herein. -14. Section 48 1.223(1)(9, Florida Statutes, prohibits a person from using or attempting to use an architect license that has been suspended, revoked, or placed on ‘inactive or ‘delinquent status. 15. Based upon the foregoing, the Respondent has violated Section 481.223(1)(, Florida Statutes, by attempting to use its certificate of authorization while it is in an inactive ‘status. WHEREFORE, Petitioner respectfully requests the Board enter an Order i imposing one or more of the following penalties: Imposition of probation, reprimand the licensee, revoke, suspend, deny the issuance or renewal of the certificate or registration, require financial restitution toa consumer, impose an administrative fine not to exceed $5,000 per count, require continuing education, assess costs associated with investigation and prosecution, impose any or all penalties delineated within Section 455. 277(2), Florida Statutes, and/or any other relief that -the Board i is authorized to impose pursuant to Chapters 4 481 and 455, Florida Statutes, and/or the tules promilgated thereunder, ; .
