An Administrative Law Judge of the Division of
Administrative Hearings has entered an Order Closing File in this
proceeding. A copy of the Order is attached to this Final Order
as Exhibit A. .
BACKGROUND
This isa proceeding to determine whether the Town of Davie
(Town) adoption of Ordinance No. 2007-20 (amendment to the
Comprehensive Plan), which includes the Town’s 07-CIE1 adopted
amendment consisting of the required annual update of the “Five
year Schedule of Capital Improvements within the Capital
Improvements Element” (financial feasibility), on August 15,
2007, is in compliance” with the Local Government Comprehensive
Planning and Land Development Regulation Act, Ch. 163, Part II,
Florida Statutes (the “Act”).

All parties to this proceeding entered into a Stipulated
Settlement Agreement which required the Town to adopt certain
remedial amendments. The Town adopted the remedial amendments
through Ordinance No. 2008-29 and the Department subsequently
published its Cumulative Notice of Intent to find the Plan
Amendment and the Remedial Amendment to be “in compliance” with
Chapter 163, Part II, Florida Statutes, and Rule 935, Florida
Administrative Code. A copy of Ordinance No. 2008-29 is attached
as Exhibit B to this document.
The Department subsequently filed a Motion to Close File and
Relinquish Jurisdiction. A copy of this Motion is appended hereto
as Exhibit C. The Administrative Law Judge issued the Order
Closing File (copy attached hereto).
ORDER
WHEREFORE, it is ORDERED that the above-captioned proceeding
is DISMISSED, and the Agency Clerk is directed to close the file.

ELEMENT WITH THE ADOPTED 5-YEAR CAPITAL PROJECTS PROGRAM FOR
FY 2007-2011 PURSUANT TO CHAPTER 163, FLORIDA STATUTES; PROVIDING
FOR FILING WITH THE DEPARTMENT OF COMMUNITY AFFAIRS; PROVIDING
FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Section 163.3177, Florida Statutes requires that local governments adopt a
financially feasible annually updated five-year schedule of capital improvements as part of the Capital
Improvements Element of the Comprehensive Plan; and
WHEREAS, the Town of Davie adopted by Resolution (#2006-299) the 5-year capital projects
program for the Town of Davie for fiscal years 2007-2011; and
WHEREAS, the Town of Davie adopted LA(TXT) 4-3-07 (Ord. #2007-20) an amendment to the
Capital Improvements Element of the Comprehensive Plan incorporating the revised 5-Year Capital
Projects Program for FY 2007-2011; and
WHEREAS, on October 16, 2007 the Department of Community Affairs determined that the
update to the Capital Improvements Element adopted via Ordinance 2007-20 was not in compliance
with the requirements of Chapter 163, Part II, F.S. due to the lack of financial feasibility of certain
projects listed within the Five-Year Capital Projects Program FY 2007-2011; and
WHEREAS, in an attempt to overcome DCA objections the Town of Davie adopted by
Ordinance (#2008-6) the revised 5-year capital projects program for the Town of Davie for fiscal years.
2007-2011; and -
WHEREAS, in an attempt to overcome DCA objections the Town of Davie adopted LA(TXT) 4-
3-07 (Ord. #2008-7) a revised amendment to the Capital Improvements Element of the Comprehensive
Plan incorporating the revised 5-Year Capital Projects Program for FY 2007-2011; and
WHEREAS, upon resubmittal of the revised amendment LA(TXT) 4-3-07 to the Department of
Community Affairs, seven projects were determined to have funding sources not financially feasible
pursuant to Chapter 163; and
WHEREAS, on July 16, 2008 the Town received a settlement agreement from DCA indicating
that Exhibit A contains the remedial actions needed for compliance; and
WHEREAS, the Town Council of the Town of Davie wishes to revise application LA(TXT) 4-3-
07, to incorporate the revised adopted Five-Year Schedule of Capital Projects Program for FY 2007-
2011 in order to satisfy the requirements of the law pursuant to Chapter 163, Florida Statutes and the
provisions of the stipulated settlement agreement; and
WHEREAS, the Town Council of the Town of Davie held a public hearing duly advertised as
required by Chapter 163.3184, F.S. on August 6, 2008 and on the date of adoption of this Ordinance;
and
WHEREAS, the Town Council of the Town of Davie desires to adopt the revised
Comprehensive Plan Amendment (LA(TXT) 4-3-07) provided herein and transmit same to the State of
Florida Department of Community Affairs (DCA) for a compliance review.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF DAVIE,
FLORIDA.
SECTION 1. The Capital Improvements Element of the Town’s Comprehensive Plan is hereby
amended as set forth on Exhibit “A”, attached hereto and made a part hereof.
SECTION 2. The Town Council hereby authorizes the appropriate Town officials to submit the
appropriate number of copies of this ordinance and the Town’s Comprehensive Plan, as amended herein,
to the State of Florida Department of Community Affairs and to any other governmental agency having
jurisdiction with regard to the approval of same in accordance with and pursuant to Chapter 163, Florida
Statutes.
SECTION 3. All Ordinances or parts of Ordinances in conflict herewith are to the extent of such
conflict hereby repealed.
SECTION 4. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is,
for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion
shall be deemed a separate, distinct, and independent provision and such holding shall not affect the
validity of the remaining portion of this Ordinance.
SECTION 5. The effective date of this plan amendment shall be the date a final order is issued
by the Department of Community Affairs or Administration Commission finding the amendment in
compliance in accordance with Section 163.3184, F.S.

Projects listed in the “Unfunded” category means that funding for these projects is not yet identified
within the Town’s budget for the foreseeable future. Town officials may be carefully evaluating and
considering various funding scenarios for these projects, but specific details and revenues have not
been secured. These “unfunded” projects are a valuable planning tool in that they identify very
important needs and long-term initiatives that the Town must continue to evaluate and allow for future
lanning consistent with the priorities of future Town Councils, citizen input, and the Town’s
Comprehensive Plan.
In addition, subsequent Five Year Schedules of Capital Improvements ad the Town will
identify the projects needed to achieve or maintain adopted level of service standards for public
facilities. These schedules of capital improvements will include committed funding sources in the first
three years and committed or planned sources of funding for years four and five as defined in Section
163.3164(32), F.S. and described in Section 163.3177(3)(a)5, F.S.

PETITIONER DEPARTMENT OF COMMUNITY AFFAIRS’ MOTION
TO CLOSE FILE AND RELINQUISH JURISDICTION
Petitioner State of Florida Department of Community Affairs
(Department), pursuant to Rule 28-106.204, Florida Administrative
Code, hereby files this Motion to Close File and Relinquish
Jurisdiction, and states:
1. On August 20, 2008, The Town of Davie adopted certain
remedial comprehensive plan amendments by Ordinance 2008-25
pursuant to a Stipulated Settlement Agreement. The Stipulated
Settlement Agreement with attachments was filed with the Division
of Administrative Hearings on August 11, 2008.
2. The Department reviewed these remedial amendments,
determined that they fully address the compliance issues raised
in this matter, and issued a Cumulative Notice of Intent on
September 21, 2008 (date of publication), to find the amendments

subject to this proceeding, as remediated, in compliance. A true
and correct copy of the Cumulative Notice of Intent is attached
hereto as Exhibit A.
3. The Town of Davie and the Department were the only
parties to this proceeding. All of the parties signed the
stipulated settlement agreement. No other party has filed a
petition regarding the Cumulative Notice, and the time for doing
so has expired. Accordingly, there is no need to realign parties
and continue this matter under the authority of Sections
163,.3184(9) & 163.3184(16) (f#)1., Florida Statutes. All parties
agree this file should be closed at the Division of
Administrative Hearings, and jurisdiction should be relinquished
back to the Department for the entry of a Final Order.
WHEREFORE, the Department respectfully requests that this
Motion to Close File and Relinquish Jurisdiction be granted; that
this file be closed at the Division of Administrative Hearings;
that jurisdiction be relinquished to the Department; and that
such other relief consistent with this Report and Motion be
granted as is just and fair.

NOTICE OF INTENT TO FIND THE
TOWN OF DAVIE
COMPREHENSIVE PLAN AMENDMENT
AND REMEDIAL COMPREHENSIVE PLAN AMENDMENT
IN COMPLIANCE
DOCKET NO. 08R1-NOI-0606-(A)-(1) -
The Department issues this cumulative notice of intent to find the Town of Davie
Comprehensive Plan Amendment adopted by Ordinance No. 2007-20 on August 15, 2007, and
the remedial amendment adopted by Ordinance 2008-29 on August 20, 2008, IN COMPLIANCE,
pursuant to Scctions 163.3184, 163.3187 and 163.3189, F.S.
The adopted Town of Davie Comprehensive Plan Amendment and the Department's
Objections, Recommendations, and Comments Report, (if any), are available for public
inspection Monday through Friday, except for legal holidays, during normal business hours, at the
Town of Davie, Development Services Department, 6591 Orange Drive, Davie. Florida 33314-
3399.
Any affected person, as defined in Section 163.3184, F.S., has a right to petition for an
administrative hearing to challenge the proposed agency determination that the Remedial
Amendments are In Compliance, as defined in Subsection 163.3184(1), F.S. The petition must be
filed within twenty-one (21) days after publication of this notice, and must include all of the
information and contents described in Uniform Rule 28-106.201, F.A.C. The petition must be
filed with the Agency Clerk, Department of Community Affairs, 2555 Shumard Oak Boulevard,
Tallahassee, Florida 32399-2100 and a copy mailed or delivered to the local government, Failure
to timely file a petition shall constitute a waiver of any tight to request an administrative
proceeding as a petitioner under Sections 120.569 and 120,57, F.S, Ifa petition is filed, the
purpose of the administrative hearing will be to present evidence and testimony and forward a
recommended order to the Department. If no petition is filed, this Notice of Intent shall become
final agency action.
If a petition is filed, other affected persons may petition for leave to intervene in the
proceeding, A petition for intervention must be filed at least twenty (20) days before thc final
hearing and rust include all of the information and contents described in Uniform Rule
28-106.205, F.A.C. A petition for leave to intervene shall be filed at the Division of ;
Administrative Hearings, Department of Administration, 1230 Apalachee Parkway, Tallahassee,
Florida 32399-3060. Failure to petition to intervene within the allowed time frame constitutes a
waiver of any tight such a person has to request a hearing under Sections 120.569 and 120.57,
FS., or to participate in the administrative hearing.
After an administrative hearing petition is timely filed, mediation is available pursuant to
Subsection 163.3189(3)(a), F.S., to any affected person who is made a party to the proceeding by
filing that request with the administrative law judge assigned by the Division of Administrative
Hearings. The choice of mediation shall not affect a party's right to an administrative hearing.
