ADMINISTRATIVE COMPLAINT
The DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, DIVISION OF HOTELS AND
RESTAURANTS, (‘Petitioner’), files this Administrative Comptaint against 18TH PLACE APTS,
("Respondent’}, and says:
1. Petitioner is the state agency charged with requiating the operation. of public lodging establishments and
public food service establishments, pursuant te Section 20.165 and Chapter 509, Florida Statutes.
2, Respondent is, and has been at all times materlal hereta, licensed by or subject to the jurisdiction of the
Division of Hotels and Restaurants, The respondent's business address of record is 4105 18TH PLACE,
VERO SEACH, FLORIDA 32960. The mailing address of record is 18TH PLAGE APTS, at 4911 EAGLE
DRIVE, FORT PIERCE, FLO RIDA 34951.
3, inspection of this establishment conducted pursuant to Ses. 509.092, Florida Statutes, revealed violations
of the provisions of Chapter 509, Florida Statutes, and / or the rules promulgated thereto governing
operation of the establishment. The violation(s) found. and applicable law are described in Exhibit "A,"
attached hereto and incorporated herein by reference. Inspection documents are attached as Exhibit ‘B”,
Incorporated herein by reference.
WHEREFORE, Petitioner respectfully requests entry of an Order imposing one or more of the following
penalties: administrative fine not to exceed $1,000 per offense; mandatory attendance at Respondent's
expense at an educational program sponsored by the Department's Hospitality Education Program,
suspension, revocation, or refusal of a license issued pursuant to this Chapter, and/or any other relief
authorized by Chapter 509, Florida Statutes, or the rules promulgated thereto.

509(FS) and/or the Rules of the Division of Hotels and Restaurants, Florida Administrative Code (FAC), in the

incorporated by reference as Exhibit B.
* 9 4.01-03 61C-1.004(9"A)FAC FIRE EXTINGUISHER INSTALLATION — FIRE EXTINGUISHERS
SHALL BE INSTALLED IN ACCORDANCE WITH NFPA 10, STANDARD FOR PORTABLE FIRE
EXTINGUISHERS. [LOW] HAZARD . LOCATIONS INCLUDE GUEST ROOM AREAS OF HOTELS/MOTELS,
ETC, [THESE LOCATIONS SHALL BE PROTECTED BY THE INSTALLATION OF POTABLE FIRE
EXTINGUISHERS WITH A MINIMUM RATING OF] 2-A10BC PROVIDED FOR EACH 3000 SQUARE FEET
OF FLOOR SPACE ON EACH LEVEL AND INSTALLED SQ THAT THE TRAVEL DISTANCE TO ANY
EXTINGUISHER SHALL NOT EXCEED 75 FEET. ON EACH FLOOR LEVEL, THE AREA PROTECTED AND
THE TRAVEL DISTANCES SHALL BE BASED OF FIRE EXTINGUISHERS INSTALLED IN ACCORDANCE
WITH TABLES 3-2.1 AND 3-3.1.
THERE WERE NO FIRE EXTINGUISHERS PROVIDED,
* 2.04-05 NFPA 101, 19-3.4.4.1 NON-TRANSIENT LODGING ESTABLISHMENTS: EACH NON-
TRANSIENT LODGING ESTABLISHMENT SHALL BE PROTECTED BY THE INSTALLATION OF SINGLE
STATION SMOKE DETECTORS POWERED BY THE BUILDING ELECTRICAL SUPPLY INSTALLED IN
SUCH A WAY AS TO PROVIDE CLEAR SIGNALING TO THE SLEEPING AREAS. BATTERY POWERED
SMOKE DETECTORS ARE PERMITTED IN THOSE ESTABLISHMENTS THAT ARE THREE STORIES OR
LESS IN HEIGHT WITH DIRECT ACCESS TO THE OUTSIDE, FROM EACH LIVING UNIT.
THERE WERE NO SMOKE DETECTORS PROVIDED.
* 806-02 61C-1.004(10) FAG MEANS OF ACCESS MUST PERMIT UNOBSTRUCTED TRAVEL AT
ALL TIMES AND BE MAINTAINED FREE OF OBSTRUCTIONS
THE BACK EXITS TO SEVERAL UNITS WERE OBSTRUCTED.
4.18-01 61C-1.004(6)FAG — ALL BUILDING STRUCTURAL COMPONENTS, ATTACHMENTS AND
FIXTURES SHALL BE KEPT IN GOOD REPAIR, GLEAN AND FREE OF OBSTRUCTIONS.
THE SOFFIT (4105-4107) HAD BEEN RIPPED OFF AND WAS MISSING.
