Rodgers, Respondent. / ADMINISTRATIVE COMPLAINT The Criminal Justice Standards and Training Commission, hereinafter referred to as the Commission, files this Administrative Complaint against the Respondent, Eric D. Rodgers. The Commission seeks to. impose disciplinary "action upon the referenced individual based on the following allegations: 1. Respondent was certified by the Criminal Justice Standards and Training Commission on December 18, 1998 and was issued Corrections Certification ‘Number 186961 and on November 8, 2005 and was issued Law Enforcement Certification Number 252796 and on November 17, 2003 and was issued Instructor Certificate Number 235454.. 2. (a) On or about July 24, 2004, the Respondent, Eric D. Rodgers, did unlawfully attempt to commit a sexual battery upon Amanda Feehley, a person twelve years of age or older, without said person’s consent, by attempting to engage in sexual intercourse, and in the process thereof used physical force and violence not likely to cause serious personal injury. (6) On or about July 24, 2004, the Respondent, Eric D. Rodgers, did unlawfully enter or remain in a certain dwelling or structure, to-wit: Towne Place Suites, a hotel located at or in the vicinity of 1876 N.E. Capital Circle Apt # 309, the property of Towne Place Suites, as owner or custodian thereof, with the intent to commit an offense therein, to-wit: Sexual Battery. 3. The actions of the Respondent did violate the provisions of Section 794.011 and or 810.02 Florida Statutes or any lesser included offenses, Section 943.1395(6) and/or (7), Florida Statutes, and/or Rules 11B- 27.0011(4)a and/or 11B-20.0012(1) (£), Florida Administrative Code, in that Respondent has failed to maintain the qualifications established in Section 943.13(7), Florida Statutes, which require that a Corrections officer,and/or Law Enforcement officer and/or Instructor in the State of Florida have good moral character and which gives rise to a disciplinary action against Respondent's certification. 4. This Administrative Complaint is issued pursuant to Sections 120.60, 943.12(3) and 943.1395(6) and/or (7), Florida Statutes. Any proceedings concerning this Complaint shall be conducted pursuant to Sections 120.569 and 120.57, Florida Statutes, and Rules 11B-27, 28-106, and 28-107, Florida Administrative Code. Mediation is not available under Section 120.573, Florida Statutes. WHEREFORE, it is alleged that the Respondent, Eric D. Rodgers is guilty of violating Sections 943.1395(6) and/or (7), and/or 943.13(7), Florida Statutes, and/or Rules 11B-27.0011(4)a and/or 11B-20.0012(1)(f£), Florida Administrative Code. NOW, THEREFORE, the Florida Criminal Justice Standards and Training Commission hereby complains against Eric D. Rodgers and alleges that an appropriate penalty, as provided in Section 943.1395(6) and/or (7), Florida Statutes, should be imposed for the reasons set forth above and in accordance with the Election of Rights form (to which is attached an Explanation of Rights form) attached hereto and incorporated herein.
