PLAI | COMES NOW the Petitioner, Department of Health, and files this Administrative Complaint before the Board of Medicine against Inge Konietzko, M.D., Respondent, and alleges: | 1. Petitioner is the state department charged with regulating the | practice of medicine pursuant to Section 20.43, Florida Statutes; Chapter 456, Florida Statutes; and Chapter 458, Florida Statutes. ! 2. At all times material to this Complaint, Respondent was a licensed medical doctor within the state of Florida, having been issued license number ME 22828. At all times material to this order, Respondent was a retired anesthesiologist. - | 5. _ Onor about June 17, 2007, Patrolman William J. Amason of the Atlantis Police Department, Atlantis, Florida, was called to Respondent's residence. Upon arriving, Patrolman Amason spoke with Respondent for / approximately one hour and became concerned that she was suffering from mental lapses. 6, Patrolman Amason returned to Respondent's residence on June 18, 2007, and found the front door open. After calling backup, he entered "and found Respondent in bed, with her dresser upturned, numerous vases broken and debris strewn across the floor. Respondent had @ severely bruised elbow and blood was smeared on her dresser. Fire Medics were called. Respondent acknowledged to Patrolman Amason that she had fallen and the damage had occurred in her attempts to get up. She stated she did not call for help because she could not get to the telephone, even though it was on her nightstand next to the bed. 7. ~ While the Fire Medics cared for Respondent, Patrolman Amason JePSU Medical DIANE* Konietzko\ AC 2007-18142.doe : 2 i i May & 2008 11:20 a ; May 8 2008 10:20 P.13 we! ~ | and other officers from the Atlantis Police Department checked the residence. They found numerous prescription bottles, most of which were empty. 3. All police and fire personnel agreed that Respondent's mental state did not appear to be rational and that she would not be able to care for herself if left alone. Respondent agreed to be transported to JFK Medical Center (JFK) for evaluation. 9, Patrolman Amason made contact with local friends of Respondent who expressed concern about her deteriorating mental state and her continued well-being. The Department of Children and Family Services was contacted. : 10. Subsequently on June 24, 2007, Patrolman Amason returned to - Respondent's residence to secure some personal items for her. At that time he examined the prescription bottles more closely and discovered that they were written for three other people (LR., D.R., and FW) by Respondent. Most were empty. When he took the personal iterns to ; Respondent at JFK, his atternpt to talk with Respondent demonstrated her confused mental state and her inability to engage in a rational conversation. A psychiatric consultation at JFK indicated an axis I diagnosis of “psychosis, OS, rule out psychosis secondary to her general medical condition, (delirium due to opiate withdrawal versus post concussion and confusional state). Rule out opiate ... dependent.” The notes further discuss her level of agitation and indicia that the agitation may be the result of withdrawal from Percocet. However, Respondent also demonstrated tangential thinking, limited insight and judgment, and impaired mental status. Scans reflected brain atrophy and ischemia. 12. A subsequent psychiatric and addictive disease evaluation was performed on September 17, 2007. During that evaluation Respondent expressed the intention to continue to practice medicine, although fo a limited degree. The evaluator diagnosed Axis I—Opiate Abuse, r/o _ dependency (DSM-IV-TR 305.50). 43. The Evaluator further determined that Respondent was not safe to practice unless she was further evaluated and under a) monitoring contract with the Professionals Resource Network. Finally, that evaluator recommended a neuropsychiatric evaluation to rule out possible Organic Brain Dysfunction. | 14. The evaluator’s opinion was that Respondent suffers from cognitive deficits in attention, memory, and executive function that would impair her ability to continue to practice medicine in a competent manner. ° safe and 15. Specifically, the neuropsychologist’s diagnostic impressions are: Axis I—Cognitive Disorder, NOS; Axis II—Deferred; Axis IfI—Motor Vehicle Accident, Brain Atrophy and Ischemic Changes. 16. Respondent is currently voluntarily withdrawn from practice. 17. Section 458.331(1)(s), Florida Statutes (2006), provides that being unable to practice medicine with reasonable skill and patients by reason of illness or use of alcohol, drugs, narcotics, safety to | chemicals, or any other type of material or as a result of any mental or physical condition constitutes grounds for disciplinary action. by the Medicine. | | Board of | 18.
