Petitioner is the state agency charged with regulating the practice of building code administration and inspection pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 468, Part XII, Florida Statutes. 2. Respondent's address of record with Petitioner is 2930 Waterford Drive South, Deerfield Beach, Florida 33442. 3, Respondent is currently licensed in the State of Florida as a Building Inspector, having been issued license number BN 961. 4. Records obtained from the City of Boca Raton Building Department revealed that Respondent performed the plumbing plans examining for Boca Raton Building Permit #04-1804, on June 9, 2005. 6. On June 5, 2006, Respondent admitted he had been performing plumbing plans review for the last year and a half. Respondent is employed by the City of Boca Raton and stated his title is Senior Plumbing Plans Examiner. Investigation by the Department of Business and Professional Regulation revealed Respondent applied for his Plumbing Provi sional Plans Review License on April 15, 2003 and that DBPR mailed Respondent a deficiency Jetter on May 28, 2003. 7. At no time material hereto was Respondent licensed as a plans examiner in the State of Florida. 8. Section 468.629(1)(a), Florida Statutes, provides: No person may falsely hold himself or herself out as a certificate holder. 9. Based on the foregoing, the Respondent violated Section 468,629(1)(a), Florida Statutes, by falsely holding himself out as a certificate holder without being properly licensed by the Department of Business and Professional Regulation. WHEREFORE, Petitioner respectfully requests the Board enter an Order imposing ofie or more of the following penalties: place on probation, reprimand the licensee, revoke, suspend, deny the issuance or renewal of the certificate or registration, impose an administrative fine not to exceed $5,000 per violation, requite continuing education, assess costs associated with investigation and prosecution, impose any oT all penalties delineated within Section 455,227(2), Florida Statutes, and/or any other relief the Board or Department is authorized to impose pursuant to Chapters 468, 455, Florida Statutes, and/or the rules promulgated thereunder.
