ADMINISTRATIVE COMPLAINT
Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION
(“Department”), files this Administrative Complaint before the Barbers’ Board, against ANDRE’
D, BAKER (“Respondent”), and says:
1. Petitioner is the state agency charged with regulating the practice of barbering
pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 476, Florida Statutes, and the
rules promulgated thereto.
2. Respondent’s address of record is 10225 Lancashire Drive East, Jacksonville, FL
32219,
3. At all times material hereto, Respondent was licensed as a barber by the State of
Florida with license number BB 55099,
4. On October 30, 2007, Petitioner’s inspector conducted an inspection of CLEAN
CUTZ, located at 3138 Loree Street, Jacksonville, FL 32219.
5. During the inspection, Petitioner’s inspector observed Respondent performing
barbering services for compensation.

6. During the inspection, a search of Department of Business and Professional
Regulation records revealed that the Respondent was delinquent.
7. During the inspection, a search of Department of Business and Professional
Regulation records revealed that CLEAN CUTZ barbershop license was in Applicant status..
COUNT ONE
8. Petitioner re-alleges and incorporates the allegations set forth in paragraphs one
(1) through seven (7) as though fully set forth herein.
9, Section 476.194(1)(e)1, Florida Statutes, provides that it is unlawful for any
person to “[o]wn, operate, maintain, open, establish, conduct, or have charge of, either alone or
with another person or persons, a barbershop which is not licensed under the provisions of this
chapter,”
10. Based on the foregoing, Respondent violated Section 476.194(1)(e)1, Florida
Statutes, by operating a barbershop that was not properly licensed, and is therefore subject to
disciplinary action by the Barbers’ Board pursuant to Section 476.204(2), Florida Statutes.
COUNT TWO
Il. Petitioner re-alleges and incorporates the allegations set forth in paragraphs one
(1) through seven (7) as though fully set forth herein.
12, Section 476.194(1)(2),; Florida Statutes, provides that it is unlawful for any person
to “[E]}ngage in the practice of barbering without an active license as a barber issued pursuant to
the provisions of this act by the department.”
13. Based on the foregoing, Respondent violated Section 476.194(1)(a), Florida
Statutes, by practicing barbering with a delinquent license, and is therefore subject to
disciplinary action by the Barbers’ Board pursuant to Section 476.204(2), Florida Statutes:

WHEREFORE, Petitioner respectfully requests the Barbers’ Board enter a Final Order
imposing one or more of the following penalties: imposition of an administrative fine, revocation
or suspension of the Respondent’s license, issuance of a reprimand, placement of the Respondent
on probation, restriction of Respondent's practice, and or any other relief which the Board deems
appropriate.
