Pharmacy against Respondent, David L. Brennan, R.Ph., and alleges: mene e Petitioner is the state department charged with regulating the practice of pharmacy pursuant to Section 20.43, Florida Statutes; Chapters 456, Florida Statutes; and Chapter 465, Florida Statutes. 2. — At all times material to this Complaint, Respondent was a licensed pharmacist within the state of Florida, having been issued license number PS 32515. 3. (Bi-Wise) 5. Onor about January 12, 2005, Bi-Wise shipped or mailed a prescription for hydrocodone to patient BK at an address in Cordova, Tennessee. 6. On or about April 12, 2005, Bi-Wise shipped or mailed a prescription for hydrocodone to patient JH at an address in Cordova, Tennessee. 7. In January 2005, Bi-Wise was not licensed by the Tennessee Board of Pharmacy to dispense medications to residents of Tennessee. aA MTENTITY RTs SP anor nt i ss sales Tennessee, 9. The state of Tennessee requires pharmacies that ship, mail, deliver, dispense, and/or provide prescription drugs and/or devices to state residents be licensed by the Tennessee Board of Pharmacy. On or about April 7, 2005, the Tennessee Board of Pharmacy issued a cease and desist letter to Bi-Wise. 11. Section 465.016(1)(r), Florida Statutes (2004), provides that violating any provision of Chapter 465, Florida Statutes, or Chapter 456, Florida Statutes, or any rules adapted pursuant thereto . constitutes grounds for disciplinary action by the Board of Pharmacy. - 12, Section 456.072(1)(k), Florida Statutes (2004), provides that failing to perform any statutory or legal obligation placed upon a licensee constitutes grounds for disciplinary action by the Board of Pharmacy. 13.
