Winn, as Commissioner of Education, files this Adotinistralive Complaint against KAREN LEE SAMSON. The Petitioner seeks the appropriate disciplinary sanction of the Respondent's cducator’s certificate pursvant to Sections 1012.795 and 012.796, Florida Statutes, and pursuant to Rule 613-1.006, Florida Administrative Codec, Principles of Professional Conduct for the Education Profession in Florida, said sanctions specifically set forth in Sections 101 2,795(1) and 1012.796(7), Florida Stututes. The Petitioner alleges: JURISDICTION 1, The Respondent holds Florida Educator’s Certificate 552615, covering the areas of English to Speakers of Other Languages (ESOL) and Mentally Handicapped, which is valid through June 30, 2011. 2. Atall times pertinent hereto, the Respondent was cmployed as a Teacher at Driftwood Elementary School in the Broward County School District. MATERIAL ALLEGATIONS | 3. On or about July 12, 2002, Respondent was driving while intoxicated or otherwise | impaired when she rear-ended two othcr vehiclcs that were stopped at a red light, causing property damage to both. No evidence exists to show that Respondent attempted to stop. Respondent failed ficld sobriety tests and tested with blood alcohol ievels of .182 and . 186. Respondent was arrested and charged with: Count 1, Driving Under the Influence; Count 2, Driving Under the Influence with Property Damage; Count 3, Failure to Use Due Care; Count 4, No Proof of Insurance. The court adjudicated Respondent guilty "of Count 1 and withheld adjudication of guilt as to count 4. Counts 2 and 3 were dismissed. Respondent was sentenced to six months probation and fifty hours of community service. Additicnatly, Respondent wzs required to make restitution to the other drivers, be subject to random breath and urine analysis, undergo an evaluation and attend DUT school. Ss E VIOLATIONS COUNT 1: The Respondent is in violation of Section 1012.795(1)(c), Klorida Statutes, in that Respondent has bcen guilty of gross immorality or an act involving mora) turpitude. CGUNT 2: The Respondent is in violation of Sectiou 1012.795(1)(e), Florida Statutes, in that Respondent has becn convicted of a misdemeanor, felony, or other criminal charge, other than a minor traffic violation. COUNT3: — The Respondent is in violation of Section 1012.795(2), Florida Statutes, which provides that the pica of guilty in any court or the decision of guilty by any court is prima facie proof of grounds for the revocation of the certificate. (SIGNATURE ON FOLLOWING PAGE) Mar 20 2009 9:54 MAR-28-2889 89:06 From: EPC 85@2459489 To:8509216847 P.4-4 KAREN LEE SAMSON Administrative Complaint Page 3 of 3 WHEREFORE, bascd on the reasons sct forth herein and in accordance with the Explanation of Rights and Election of Rights forms attached to and made a part of this Adroinistrative Complaint, Petitioncr respectfully recommends that the Fducatiun Practices Commission imposc an appropriate sanction against the Respondent’s educator’ s certificate pursuant to the authority provided in Sections 1012.795(L) and 1012.796(7), Florida Statutes. ‘Ihe sanctions imposed by the Education Practices Commission may include, but are not limited to, any one or a combination of the following: issuing the Respondent a written reprimand; placing the Respondent on probation for any period of time; restricting the Respondent’s authorized scope of practice; assessing the Respondent an administrative fine; directing the Respondent to enroll in the Recovery Network Program; suspending the Respondent's educator’s certificate for a period of time not to exceed five years; revoking the Respondent's educator’s certificate for a period of time up to 10 years er permanently; or barring the Respondent from reapplying for an educator's certificate for a period of time up to 10 years or permanently.
