ARIAS, Respondent. / ADMINISTRATIVE COMPLAINT State of Florida, Department of Business and Professional Regulation, Division of Real Estate (“Petitioner”) files this Administrative Complaint against Gustavo M. Arais (“Respondent”) and alleges: ESSENTIAL ALLEGATIONS OF MATERIAL FACT 1. Petitioner is a state government licensing and regulatory agency charged with the responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State of Florida, in particular Section 20.165 and Chapters 120, ass and 475, of the Florida Statutes and the rules promulgated pursuant thereto. 2. Respondent is and was at all times material hereto a licensed Florida real estate broker, issued license numbers 594401; 3095299; and 3010081 in accordance with Chapter 475 of the Florida Statutes. The last license issued was as a broker at 7614 Coconut Creek Court, Orlando, Florida 32822; Frangio & Ru-Ni Inc., 437 W. Vine Street, Kissimmee, Florida 34741; and Florida Living, Inc., P O Box 721298, Orlando, Florida 32872-1298. 4. Respondent is the qualifying broker for Florida Living Inc., a licensed brokerage in the state of Florida. 5. At all times material Respondent negotiated the sale and purchase of a property owned by Arnaldo Colon (Seller) with Olga Kaye, (Buyer) located at 4723 Club Circle Drive, lake Wales, FL, (Subject Property) for $35,000, with Florida Living Inc., as escrow agent with Park Place Title, Inc., as the closing agent. A copy of the contract is attached hereto and incorporated herein as Administrative Complaint Exhibit 1. 6. on or about December 10, 2004 Respondent received from: ‘Buyer cashiers check # 0040701334 for $10,000 for the purchase of Subject Property. A copy of the check is attached hereto and incorporated herein as Administrative Complaint Exhibit 2. 7. On or about February, 10 2005 Respondent received from Buyer cashiers check # 0040701662 for $6,173.06 for the purchase of the Subject Property. A copy of the check is attached hereto and incorporated herein as Administrative Complaint Exhibit 3. 8. Respondent failed to deposit the Buyer’s funds into an escrow account. Respondent deposited Buyers funds into the operating account of Florida Living Inc., a for profit corporation, in which Respondent is an officer/Director. A copy of the corporate record is attached hereto and incorporated herein as Administrative Complaint Exhibit 4. COUNT ONE Based upon the foregoing, Respondent is guilty of failure to maintain trust funds in the real estate brokerage escrow bank account or some other proper depository until disbursement thereof was properly authorized in violation of Section 475.25(1) (k), Florida Statutes. COUNT TWO Based upon the foregoing, Respondent is guilty of failure to immediately deposit trust funds in violation of Rule 61072-14.010 of the Florida Administrative Code and, therefore, in violation of Section 475.25(1)(e), Florida Statutes. WHEREFORE, Petitioner respectfully requests the Florida Real Estate Commission, or the Department of Business and Professional Regulation, as may be appropriate, to issue a Final Order as final agency action finding the Respondent(s) guilty as charged.
