ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, (“Petitioner”), files this Administrative Complaint before the Construction Industry Licensing Board, against CHAD E. WATSON, (“Respondent”), and says: 1. Petitioner is the state agency charged with regulating the practice of contracting pursuant to Section 20,165, Florida Statutes, and Chapters 455 and 489, Florida Statutes. 2, Respondent is, and has been at all times material hereto, a Certified General Contractor, license number coc 055221, in the State of Florida, which is currently in “current active” status and a Certified Roofing Contractor, license number CCC 056748, in the State of Florida, which is currently | in “current active” status. Respondent’s addresses of record are 1308 19t* sp Terrace, Cape Coral, Florida 33999 and P.O. Box 62262, Fr. Myers, FL 33906, 4. At all times material hereto, Respondent was the primary qualifying agent for Watco Construction, Ine, (“Watco Construction”), 5. Watco Construction possessed a qualified business license also known as a certificate of authority, License Number OB 0013005, which expired on August 31, 2007. Respondent failed to renew Watco Construction’s qualified businass license. 6. Section 489.1195(1) (a), Florida Statutes, provides that all primary qualifying agents for a business organization are jointly and equally responsible for supervision of all operations of the business organization; for all field work at all sites; and for financial matters, both for the organization in general and for each specific job. 7, On or about August 19, 2004, Respondent, doing business as Wateco Construction executed a work authorization form with Sue Evanson on behalf of the Bahama Beach Club Association (“Bahama”) to Make repairs to the residential Property located at 5370 Estero Blvd, Ft. Myers Beach, Florida 33931, following hurricanes Charley and Frances. 8. The contract failed to Contain a written statement explaining the homeowner's rights under the Florida Homeowners’ GAOGC\Fie\AC\2007-005017 Watson (0) AC.doc 3 Sep 14 2009 10:44 PAGE 85/88 ao/14/2689 16:35 8589219186 DEPR agreement or contract for repair, restoration, improvement or Gonstruction to residential real property must contain a written statement explaining the consumer’s rights under the Construction Industries Recovery Fund, except where the value of all labor and materials does not exceed $2,500.00, 16. Based on the foregoing, Respondent violated Section 489.129(1) (i), Florida Statutes, by failing in any material respect to comply with the provisions of this part or violating a rule or lawful order of the board, by having violated Section 489.1425(1), Florida Statutes. COUNT III 17. Petitioner rée-~alleges and incorporates the allegations set forth in paragraphs one through ten as though fully set forth herein. 18. Based on the foregoing, Respondent violated Section 482.129(1) (0), Florida Statutes, by proceeding on any job without first obtaining applicable local building permits and inspections.
