Torrence, Respondent. ‘ / ADMINISTRATIVE COMPLAINT The Criminal Justice Standards and Training Commission, hereinafter referred to as the Commission, files this Administrative Complaint against the Respondent, Terell Torrence. The Commission seeks to impose disciplinary action upon the referenced individual based on the following allégations: 1. Respondent was certified by the Criminal Justice Standards and Training Commission on September 5, 2003, and was issued Correctional Certificate Number 234088. 2. (a) On or about May 25, 2007, the Respondent, Terell Torrence, did unlawfully, feloniously and intentionally threaten by word or act to de violence to the person of another, to wit: Deborah Corbitt, coupled with an apparent ability to do so and did some aot, to wit: attempted to strike a motor vehicle occupied by Deborah Corbitt with the motor vehicle he was driving which created a well- founded fear in such other person that such violence was imminent, and in so doing displayed a deadly weapon, to wit: a motor vehicle without intent to kill, (b) On or about May 25, 2007, the Respondent, Terell Torrence, did unlawfully, willfully and maliciously injure or damage any real or personal property belonging to Takina Minnis by damaging Takina Minnis’s vehicle, causing damage in an amount not exceeding 51000. (e) On of about May 25, 2007, the Respondent, Terell Torrence, did knowingly and unlawfully obtain or use, or endeavor to obtain or use, A Tag or Tags, the property of Takina Minnis, Dec 14 2009 12:40 12/14/2889 13:43 8584187699 FDLE PAGE @5/@8 with the unlawful intent to deprive Takina Minnis of a right to the property or a benefit therefrom or to appropriate the money or property to his own use or to the use of any person not entitled thereto. (d) On of about May 25, 2007, the Respondent, Tere)! Torrence, did unlawfully commit a battery upon Deborah Corbitt, by actually touching or striking Deborah Corbitt or intentionally causing bodily harm to Deborah Corbitt against her will, 3. The actions of the Respondent did violate the provisions of Section 784.02(1)(a); 806.13(1)(b), 812.014(3)(a); 784.03 or any lesser included offenses, Section 943.1395(7), Florida Statutes and Rute 11B-27.001 1(4)a; b; b; b, Florida Administrative Code, in that Respondent has failed to maintain the qualifications established in Section 943,13(7), Florida Statutes, which require that a Correctional officer in the State of Florida have good moral character. 4, This Administrative Complaint is issued pursuant to Sections 120,60 and 943.1395(7), Florida Statutes and Rule 11B-27.004(4), Florida Administrative Code. Any proceedings concerning this ~ Complaint shall be conducted pursuant to Sections 120.569 and 120.57, Florida Statutes, and Chapters 11B-27, 28-106, and 28-107, Florida Administrative Code, Mediation is not available under Section 120,573, Florida Statutes. | WHEREFORE, it is alleged that the Respondent, Terell Torrence is guilty of violating Sections 943,1395(7) and 943.13(7), Florida Statutes and Rule [1B-27.001 1(4}a; b; 6; b, Florida Administrative Code. NOW, THEREFORE, the Florida Criminal Justice Standards and Training Commission hereby complains against Terell Torrence and alleges that an appropriate penalty, as provided in, Section 943,1395(7), Florida Statutes, should be imposed for the reasons set forth above and in accordance with the Election of Rights form (to which is attached an Explanation of Rights form) attached hereto and incorporated herein.
