COMES NOW, Petitioner, Department of Health, by and through its undersigned counsel, and files this Administrative Complaint before the Board of Optometry against Respondent, ELISE ANASTASIA MILLIE, 0.D., (“Dr. Millie”) and in support thereof alleges: 1. Petitioner is the state department charged with regulating the practice of optometry pursuant to Section 20.43, Florida Statutes; Chapter 456, Florida Statutes; and Chapter 463, Florida Statutes. 2. At: all times material to this Complaint, Dr. Millie was a certified licensed optometrist (0.0) within the state of Florida, having been issued license number OP 3924, | 3. Dr. Millie’s address of record is 8021 Tribal Circle, Las Vegas, NV 89145. 4, On or about February 12, 2009, Dr. Millie self-reported disciplinary action taken against her license to practice optometry in the state of Nevada. On or about January 26, 2009, after formal hearing, the Nevada State Board of Optometry filed its Decision finding that Dr. Millie: (1) prescribed an oral steroid to a patient (2) wrote and signed for a prescription using the prescription pad of an ophthalmologist (3) who worked with Dr. Mille to provide collaborative care for a common patient; and (4) accepted employment from a person not licensed to practice optometry in the state of Nevada. 6. on or about January 26, 2009, after formal hearing, the Nevada State Board of Optontetry fi filed its Decision concluding that Nevada Statutes: (1) precludes optometrists from prescribing oral steroids; (2) provides that signing prescriptions blanks of another constitutes unethical behavior; (3) requires a co-management agreement wien collaborating with another provider to provide patient care; and (4) provides that ac ecepting employment from a person not licensed to practice optometry constitutes unethical behavior. 7. Oh or about January 26, 2009, the Nevada State Board of Optometry disciplined Dr. Millie's license to include the following: (1) 90-day suspension; (2) a $1,000 fine; and (3) one (1) year probation following completion of the 90-day suspension. ! Count 1 8. The Petitioner re-alleges and incorporates paragraphs one (1) through seven (7) as if fully set forth in this count. 9. Section 463.016(1)(c), Florida Statutes (2008), provides that having a license to practice optometry revoked, suspended, or otherwise acted against, including DOH v. On br about January 26, 2009, the Nevada State Board of Optometry disciplined Dr. Millie's license. il.
