Regulation, Division of Real Estate (“Petitioner”) files this
Administrative Complaint against John W. Minger, Jr., Steffant
Martin and Century 21 Wilson Minger Agency (“Respondent”) and
alleges:
ESSENTIAL ALLEGATIONS OF MATERIAL FACT
1. Petitioner is a state government licensing and regulatory
agency charged with the responsibility and duty to prosecute
Administrative Complaints pursuant to the laws of the State of
Florida, in particular Section 20.165 and Chapters 120, 455 and
475, of the Florida Statutes and the rules promulgated pursuant
thereto.

2. Respondent John W. Minger, Jr. is and was at all times
material hereto a licensed Florida real estate broker, issued
license number 3219650 and 60605 in accordance with Chapter 475 of
the Florida Statutes. The last licenses issued were as an active
broker at Minger Real Estate Referrals Inc., 1350 E. John Sims
Parkway, Niceville, Florida 32578 and Century 21 Wilson Minger
Agency, Inc., 1350 E..John Sims Parkway, Niceville, Florida 32578.
3. Respondent Steffany Martin is and was at all times
material hereto a licensed Florida real estate sales associate,
issued license number 3207402 in accordance with Chapter 475 of the
Florida Statutes. The last license issued was as an active sales
associate at Century 21 Wilson Minger Agency, Inc., 1350 E. John
Sims Parkway, Niceville, Florida 32578.
4. Respondent Century 21 Wilson Minger Agency, Inc. is and was
at all times material hereto a corporation registered as a Florida
real estate broker having been issued license number 220933 in
accordance with Chapter 475 of the Florida Statutes. The last
license issued was at the address of 1350 E. John Sims Parkway,
Niceville, Florida 32578.
5. At all times material hereto, Respondent John W. Minger,
Jr. was licensed and operating as qualifying broker and officer of

Respondent Century 21 Wilson Minger Agency.
6. On or about April 22, 2009, Respondents, on behalf of
Christopher V. Olson (Buyer) presented an offer to purchase to
Terry & Maria Jordan (Sellers) for a property known as 1004
Shalimar Point Dr., Shalimar, FL 32579 (Subject Property) for
$330,000 with a deposit for $1,000 to be held in escrow by South
Land Title (Escrow Agent) upon acceptance of the offer. A copy of
the offer is attached hereto and incorporated herein as
Administrative Complaint Exhibit 1.
7. Respondents knew or should have known that on or about
April 24, 2009, in reliance on Respondents’ representations, the
Sellers accepted the offer to purchase the Subject Property.
8. On or about April 22, 2009, Respondents received from
Buyer a check for $1,000 for deposit with Escrow Agent. A copy of
the check is attached hereto and incorporated herein as
Administrative Complaint Exhibit 2.
9. At all times material Respondents failed to deliver the
Buyer’s check for the purchase of the Subject Property to the
Escrow Agent.
10. On or about May 6, 2009 Respondents, on behalf of Buyer,
canceled the offer to purchase. A copy of the cancellation si

11. On or about May 6, 2009, Respondents voided the Buyer's
check and returned the negotiable instrument to the Buyer.
COUNT ONE
Based upon the foregoing, Respondent Steffany Martin is guilty
of failure to immediately place with the registered employer any
money, fund, deposit, check or draft entrusted to her as agent of
the registered employer in violation of Rule 6132-14.009 of the
Florida Administrative Code and Section 475.25 (1) (k), Florida
Statutes and, therefore, in violation of Section 475.25(1) (e),
Florida Statutes.
COUNT TWO
Based upon the foregoing, Respondent John W. Minger, Jr. is
guilty of failure to maintain trust funds in the real estate
brokerage escrow bank account or some other proper depository until
disbursement thereof was properly authorized in violation of Section
475.25(1) (k), Florida Statutes.
COUNT THREE
Based upon the foregoing, Respondent Century 21 Wilson Minger
Agency, Inc. is guilty of failure to maintain trust funds in the
real estate brokerage escrow bank account or some other proper
depository until disbursement thereof was properly authorized in

violation of Section 475.25(1) (k), Florida Statutes.
COUNT IV
Based upon the foregoing, Respondent John W. Minger, Jr. is
guilty of failure to immediately deposit trust funds in violation of
Rule 6132-14.010 of the Florida Administrative Code and, therefore,
in violation of Section 475.25(1)(e), Florida Statutes.
COUNT FIVE
Based upon the foregoing, Respondent Century 21 Wilson Minger
Agency is guilty of failure to immediately deposit trust funds in
violation of Rule 61032-14.010 of the Florida Administrative Code
and, therefore, in violation of Section 475.25(1)(e), Florida
Statutes.
WHEREFORE, Petitioner respectfully requests the Florida Real
Estate Commission, or the Department of Business and Professional
Regulation, as may be appropriate, to issue a Final Order as final
agency action finding the Respondent(s) guilty as charged. The
penalties which may be imposed for violation(s) of Chapter 475 of
the Florida Statutes, depending upon the severity of the
offense(s), include: revocation of the license or registration or
permit; suspension of the license, registration or permit for a
period not to exceed ten (10) years, imposition of an

administrative fine of up to $5,000 for each count or offense;
imposition of investigative costs; issuance of a reprimand;
imposition of probation subject to terms including, but not limited

combination of the foregoing which may apply. See Section
475.25(1), Florida Statutes and Florida Administrative Code Rule
6102-24.001. The penalties which may be imposed for violation(s)
of Chapter 455 of the Florida Statutes, depending upon the severity
of the offense(s), include: revocation of the license,
registration, or permit; suspension of the license, registration,
or permit for a period not to exceed ten (10) years; imposition of
an administrative fine of up to $5,000 for each count or offense;
imposition of investigative costs; issuance of a reprimand;

duces tecum issued on your behalf if a formal hearing is requested.
