CASE NO. 2008055515 MICHELLE LOPEZ, Respondent. / ADMINISTRATIVE COMPLAINT The Florida Department of Business & Professional Regulation, Division of Real Estate ("Petitioner") files this Administrative Complaint against Michelle Lopez("“Respondent"), and alleges: ESSENTIAL ALLEGATIONS OF MATERIAL FACT 1. Petitioner is a state government licensing and regulatory agency charged with the responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State of Florida, including Section 20.165 and Chapters 120, 455 and 475 of the Florida Statutes, and the rules promulgated thereunder. 2. Respondent is currently a Florida state certified residential real estate appraiser having been issued license 5272 in accordance with Chapter 475 Part II of the Florida Statutes. 3. The last license the State issued to Respondent was as a state certified residential real estate appraiser at 9980 B Banana H:A\FREAB\lopez.AC.doc . 1 FDBPR v. Michelle Lopez Case No. 2008055515 Administrative Complaint Tree Run, Boynton Beach, Florida 33436. 4. It is alleged that, on or about June 18, 2007, Respondent and her trainee, Guillermo Escobar, developed and communicated to the lending institution an appraisal report for property commonly known as 713 Secret Harbor Lane Unit #203, Lake Mary, Florida 32746, a copy of which is attached hereto and incorporated herein as Administrative Complaint Exhibit 1. 5. Respondent denies preparing this report and claims someone stole her electronic signature and used it without her knowledge. Respondent said she first learned of the report when the lending institution placed her on an “at risk” list due to concerns of USPAP violations stemming from the report. She then reported to the Miami-Dade Police Department that her signature had been stolen. 6. Respondent's trainee, however, said she knew about the assignment and supervised him as he prepared the report. Neither Respondent nor the trainee provided a copy of the workfile to Petitioner upon request. Both contend the workfile is unavailable, because Respondent gave it to the police without keeping a copy. 7. At the time the Report was developed, Respondent and her trainee operated under the business name Access Appraisals Group Services, Inc., as evidenced by the Invoice for this assignment H:AFREAB\lopez.AC.doc 2 FDBPR v. Respondent registered the business address for Access Appraisal Group Services, Inc. with Petitioner, but failed to furnish the business name as required by § 475.623, Fla. Stat. See Petitioner’s licensees database printout attached hereto and incorporated herein as Administrative Complaint Exhibit 3. Public records filed with the Florida Department of State, Division of Corporations show that Respondent’s trainee was Vice-President and 49% owner of Access Appraisals Group Services, Inc. Copies of the documents are attached hereto and incorporated herein as Administrative Complaint Exhibit 4. COUNT ONE Based upon the foregoing, Respondent has violated Section 475.623, Florida Statutes, by failing to furnish, in writing, to the department each firm or business name and address from which she operates in the performance of appraisal services and, therefore, is in violation of Section 475.624(1), Florida Statutes. COUNT TWO Based upon the foregoing, Respondent is guilty of failure to retain records for at least five years of any contracts engaging the appraiser’s services, appraisal reports, and supporting data assembled and formulated by the appraiser in preparing appraisal H:\FREAB\opez.AC.doc . 3 FDBPR v. Michelle Lopez Case No. 2008055515 Administrative Complaint reports in violation of Section 475.629, Florida Statutes, and, therefore, in violation of Section 475.624 (4), Florida Statutes. COUNT THREE Based upon the foregoing, Respondent is guilty of being employed as a supervisory appraiser by a trainee in violation of Florida Admin. Code Rule 61J31-4.010(8) and Section 475.6221(3), ‘Plorida Statutes, and, therefore, in violation of Section 475.624(4), Florida Statutes. WHEREFORE, Petitioner respectfully requests the Florida Real Estate Appraisal Board, or the Department of Business and Professional Regulation, as may be appropriate, to issue a Final Order as final agency action finding the Respondent(s) guilty as charged. The penalties which may be imposed for violation(s) of Chapter 475 of the Florida Statutes, depending upon the severity of the offense(s), include: revocation of the license, registration, or certificate; suspension of the license, registration or certificate for a period not to exceed ten (10) years; imposition of an administrative fine of up to $5,000 for each count or offense; imposition of investigative costs; issuance of a reprimand; imposition of probation subject to terms including, but not limited to, requiring the licensee, registrant, or certificate H:\FREAB\lopez.AC.doc 4 FDBPR v.
