ADMINISTRATIVE COMPLAINT Petitioner, Department of Business And Professional Regulation, ("Petitioner"), files this Administrative Complaint before the Board of Building Code Administrators and Inspectors, against DARRYL A, DEMPSEY ("Respondent"), and alleges: Ll. Petitioner is the state agency charged with regulating the practice of building code administration and inspection pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 468, part XII, Florida Statutes. 2. Respondent is and has been, at all times material hereto, a licensed standard inspector in the State of Florida, having been issued license number BN 1100. 3. On or about November 26, 2007, Respondent conducted an inspection for ABI Companies at a location that had not been issued a permit. 5. On er about January 11, 2008, a permit was issued for the ABI Companies’ location that Respondent had inspected on or about November 26, 2007. 6. On or about January 15, 2008, Respondent signed the inspection report for the permit listed above dating the inspection January 15, 2008. 7. Section 468.621(1)(f), Florida Statutes, states in pertinent part: “The following acts constitute grounds for which the disciplinary actions in subsection (2) may bé taken: (mjaking or filing a report or record which the certificateholder knows to be false....” 8. Based on the foregoing, the Respondent violated Section 468.621(1) (f), Florida Statutes, by knowingly filing an inspection report with an incorrect date.
