BURTIS, Respondent. / ADMINISTRATIVE COMPLAINT The Department of Business and Professional Regulation (“Petitioner”), files this Administrative Complaint before the CONSTRUCTION INDUSTRY LICENSING ROARD, DIVISION II (‘Board’), against CHRISTOPHER K. BURTIS (“Respondent”), and alleges: 1. Petitioner is the state agency charged with regulating the practice of contracting pursuant to Section 20.165, Florida Statutes, as 2. and Chapters 455 and 489, Plorida Statutes. At all times material hereto, Respondent was Licensed a Certified Plumbing Contractor in the State of Florida, having been issued license number CFC 56636, 3. Respondent's address of record is 2217 Twin Brooks Road, Fort Myers, Florida 33917-6506. Bacument in Unnamed 1 Nov 5 2010 11:32 11/a5/2818 11:17 8589219186 DEPR PAGE @4/11 4, On the following dates, Respondent was convicted, found guilty of, or entered a plea of nolo contendere, to crimes, including but not limited to, the following: February 23, 1996 | Trespass/Battery October 31, 2000 Workers’ Compensation Fraud April 25, 2001 Battery (Domestic Violence) 5. Respondent failed to report in writing to the Board, crimes of which Respondent was convicted, found guilty of, or entered a plea of nolo contendere to, including, but not limited to, those referenced in paragraph 4, within 30 days after the effective date of Section 455.227(1) (t), Florida Statutes. 6. Section 489.114, Florida Statutes, requires that licensed contractors maintain workers’ compensation coverage. 7. Petitioner realleges and incorporates the allegations set forth in paragraphs one through six as thouch fully set forth herein. , 8. Based upon the foregoing, Respondent violated Section 489.129(1)(b), Florida Statutes, by being convicted or found guilty of, or entering a plea of nolo contendere to, regardless ef adjudication, a crime in any jurisdiction which directly relates to the practice of contracting or the ability to practice contracting. Fetitioner realleges and incorporates the allegations get forth in paragraphs one through six as though fully set forth herein. LO. Section 455.227(1), Florida Statutes, provides in part that “[t]he following acts shall constitute grounds for which the disciplinary actions specified in subsection [455.227 (2)] may be taken. (c) Being convicted or found guilty of, or entering a plea of nolo contendere to, regardless of adjudication, a crime in any jurisdiction which relates to the practice of, er the ability to prattice, a licensee’s profession. 11. Based upon the foregoing, the Respondent violated Section 489.129(1)(c), Florida Statutes, by violating any provision of Chapter 455, Florida Statutes, by violating Section 455.227(1), Florida Statutes. COUNT THREE 12. Petitioner realleges and incorporates the allegations set forth in paragraphs one through six as though fully set forth herein. 13. (t) Failing to report in writing to the board... within 30 days after the licensee is convicted of found guilty of, or entered a plea of nolo contenderé oF guilty to, regardless of adjudication, a crime in any jurisdiction. A licensee must report a conviction, finding of guilt, plea or adjudication entered before the effective date of this paragraph within 30 days after the effective date of this paragraph. 14. Based upon the foregoing, the Respondent violated Section 489.129(1)(c), Florida Statutes, by violating any provision of Chapter 455, Florida Statutes, by violating Section 455.227(1), Florida Statutes. WHEREFORE, Petitioner respectfully requests the Construction Industry Licensing Board enter an Order imposing one or more of the following penalties: place on probation, reprimand the licensee, revoke, suspend, deny the issuance or renewal of the certificate or registration, require financial restitution to a consumer, impose an administrative fine not to exceed $10,000 per violation, require continuing education, assess costs associated with investigation and prosecution, impose any or all penalties delineated within Section 455.,227(2), Florida Statutes, and/or any other relief that the Document in Unnamed 4 Nov 5 2010 11:33 11/a5/2818 11:17 8589219186 DEPR PAGE Board is authorized to impose pursuant to Chapters 489, 455, Florida Statutes, and/or the rules promulgated thereunder.
