ADMINISTRA TIYE COMPLAINT

The Criminal )ustice Standards a11d Training Commission, hereinafter referred to as the Commission., files this Administrative Complaint against the Respondent, Kenneth Miles. The Commission seeks to impose disciplinary action upon tl1e referenced individual based on the following allegations:

1. Respondent was certified by the Criminal .Justice Standards and Training Commission on August 15, 200 I, and was issued COl'rectional Certificate Number 198367.

2. On or about October 15, 2009, the Respondent, Kenneth Miles, did unlawfully and willfully violate a11 injunction for protection against domestic violence issued pursuant to F.S. 741.30, or a foreign protectio11 order accorded full fai1:h and credit pursuant to F.S. 741.315, by going to a specified place frequented regularly by the petitioner.

3. The actions of the Respondent did violate the provisions of Section 741JI or any lesser included offenses, Section 943.1395(7), Florida Statutes and Rule 11 B-27.001 l(4)(b), Florida Administrative Code, in that Respondent has failed to maintain the qualificatio11s established in Section 943.13(7), Florida Statutes, which require that a Correctional officer in tl1c State of Florida have good moral character.

4. This Administrative Complai111 is issued pursuant to Sections 120.60 and 943.I395(7), Florida Statutes and Ru le I l B-27.004( 4), Florida Ad111 in istrativc Code. A11y proceedings concemi11g this Complaint shall be conducted pmsuant to Sections 120.569 and I 20.57, Florida Statutes, and Chapters

WHEREFORE, it is alleged that the Respo,1dent, Ke1111eth Miles is guilty of violati11g Sections 943.1395(7) and 943.13(7), Florida Statutes and Rule 11 B-27.00!I (4)(6), Florida Administrative Code.

Now, Tl-IEREFORF., the Florida Crin1inal Justice Standards and Trail1ing Commission hereby complains against Kenneth Miles and alleges that an appropriate penalty, as provided in Section 943.1395(7), Florida Statutes, should be imposed for the rcaso,1s set fo11r, above a11d in accordance with the Election of Rights form (to which is attached a11 Explanation of Rights form) attached hereto and incorporated herein.
