YOU ARR IIERKBY NOTIFIED that this is an s.dministn"ttive action. This case arises from Respondent's unlawful acts and practices and faiiure to comply with Section 381.0065 Florida Statute, Chapter 189 Part III Florida Statutc:i a.nd Chapter 64E 6-F'lorid1l Administrative

Code. Thi:-; action is authorized pursuanl lo Sections 381.0061 and 489.556 Florida Statutes> and Rule 64F.-6.022 Florida Administrative Code that govern disciplinary actions against registered septic con.tractors.

Factual Allegations as to All Counts

1. The Petitioner. Stale of Florida. Department of Ilea.1th, is lhe administrative agency of the State of Florida charged with the duty to enforce the provisions of Chapter 381 Floridu Statutes, Chupter 489 Part ITT Florida Statutes and the applicable rules contained in Chapter 64Eft6 Florida Administrative Code.

2. lhe Respondent, Martin A Guffey, is a registered septic tank contr<J.ctor,

   Registration Number SR0971.237. He is authorized to provide septic tank contracting services

   through the corporate name Martin Septic Services, Inc., Authori7.ation Number SA0071446.

3. The Respondent advertises and holds himself out to the public as n septic tru:1k contractor and engages in the practice of septic tank contractor services in at least Sara'lota and Charlotte County. The Respondent is pennitted to provide septa.gc disposal services via permit number 2010-057 PUMPER (58-Q3-00032) issued by Sarasota County Health Department.

4. The Re:,;pondent has had previous disciplinary action taken against him. On Februa1y 21, 2010, the Department entered a Pinal Order, Rendition No.DOTI-10 0418-S-HST against Martin A.    and/or Rule 64E-6.002( I )(I) l Fkirida Administrative Code. See Final Order, attached and incorporated _herein as Attachment "A". Accordingly, the violations described herein arc "repeat violatio11s" in detennining the range of disciplinary action stated in the Disciplinary Guidelines set forth in Rufo 64E 6.022 Flo1ida Administrative Code. Rule 64E 6.022(3) Florida Administrative C!'1de states:

   As used in this rule., a rep<.;at violation is any violation on which disciplinary action is being taken where the same licensee had previously had disciplinazy action taken against him or rece1ved a. letter of warning in a prior case. This definition applies regardless of the chronological relationship of the violations and regardless of whether the violations are of the same or different subsections of'this rule. The penally given in the above list for repeat violations is intended to apply only to situations where the repeat violation. is of a different subsection of this rule than the first violation. Where the repeat violation is the very same type of violation as the first violation, the penalty set out ahove will generally be increa-;ed over what is shown for repeat violations.

   
   

5. Since at least January 2006 tht! Rt!spondent has owned and operated a two lhousand gallon septic tank p1,.im.p truck, 1967 Kaise1·, vehicle ID numbered 4K6290. During this time period the Respondent has used this septic tank pum.p truck and provided septic tank pumping services to customers on Little Gasparilla Island and Cayo Costa and possibly other locations. During this time period the Respondent has obtained annual septa.ge disposal pcnnits from the Sarasota County . Health Department and has never listed this truck as one of his vehicles used to provide septage disposal servkes. During this time period the Respondent has never presented this septic tank pump truck to the Sarasota County Health Department for inspection and approval prior to pulling tho tnick into service. On or u.mund September 10, 2010

   the Sarasota Health Department became aware that the Respondent was actively using this u11permittcd septic tank pump truck and required him to hnng the truck in to the Health Department for inspection and approval to add it to his septage disposal pennit. On Sept.ember l3, 2010 the Respondent presented the unpennitted truck for inspection and approval and amended his annual :septage disposal service pennit to include this truck. See the Dc.partment's Septic Tank Service Inspection Report and Check.list attached and incorporated herein as Altachrncnt "R". See also, the amended Application for Scptagc Disposal Service Pennil, amended September 15, 2010, to include the use of the 2,000 g tllon septic pump trnck, attached a.11d incorporated herein as Attachment "C''. A picture of the 2,000 gallon septic pump truck is attached and incorporated herein as Attachment "D".

6. "The Respondent's acts and practices described herein violate Rule 64E- 6.010(2)(a) Florida Administrative Code that states that septic tank pump trucks can only be placed into service after they have been inspected and approved by the County Health Department. These violations subject the Respondent to the discipline mandated in Rule 64E 6.022(1 )(m) Florida Administrative Cc,de whi h is revocation for a. repeat violation. The

   Department hereby imposes an administrati vc fine in the amount of One Thousand Dollars ($1,000.00), in Heu of revocation, ror these .violations, against Respondent, Martin A. Guffey. This discipline has been mitigated from revocation in accordance with Rule 64E-6.022(2) Florida Administrative Code.

   Request for Relief

   Wherefore, the Department of Health hereby imposes an administrative fine in the total amount of One Thousa,r;d Dollflt's ($1,000.00) 11gttim1t R espo nd ent 1 Martin A. Guffey, Registration Number SR0971273. This line has heen mitigated from a revocation set forth in the disciplinary standards for this repeat violation.
