ADMINISTRATIVE COMPLArNT

The Criminal Justice Standarcrs and Training Commission, hereinafter referred. to as the Commission, files this Administrative Complaint against the Respondent, Mervin B. Stewart. The Commission seeks to impose disciplinary action upon the referenced individual based on the following allegations:

l. Respondent was certified by the Criminal Justice Standards a.nd Training Commission on

October 7, 1991, and was issued Law Enforcement Certificate Number 78738.

1. (a) On or about November 13, 2008, the Respondent, Mervin B. Stewart, did unlawfully make a false statement, which he did not believe to be true, under oath administered by Jerry Hill, State Attorney, in an official proceeding, to wit: Grand Jury Investigation, in regard to a material matter.

   (b) On or about November 13, 2008, the Respondent, Mervin B. Stewart, did unlawfully

   make a false statement, which he did not believe to be true, under oath 'administered by Jerry HlU, State Attorney, in an official proceeding, to wit: Grand Jury 11,vestigation, in regard to a material matter.

2. The actions of.the Respondent did violate the provisions of Section 837.02(1); 837.02(1) or any lesser ;,;eluded offc11scs, Section 943.1395(7), Florida Statutes and Rule 1 lB-27.00 l 1(4)(a); (a), Florida Administrative Code, in that Respondent has failed to maintain the qualificatio11s established in Section 943.13(7), Florida Sta!Utes, which require that a Law Enforcement officer in the State of Florida have good moral character.

3. This Admir ative Co1'nplaint is issued pursuant to S, :ms 120.60 and 943.1395(7), Florida Statutes and Rule l lB-27.004(4), Florida Administrative·Code. Any proceedings concerning this Complaint shall be conducted pursuant to Sectio11s 120.569 and 120,57, Florida Statutes, and Chapters

1 IB-27, 28-106, and 28-107, Florida Administrative Code. Mediation is not available under Section 120.573, Florida Statutes.

\VHEREFORE, it is alleged that the Respondent, Mervin B. Stewart is guilty of violating

Sections 94J.1395(7) and 943.13(7), Florida Statlttes a11d Rule 11B-27.0011(4)(a); (a), Florida Administrative Code.

NOW, THEREFORE, the Florida Criminal Justice Standards and Training Commission hereby complains against Mervin B. Stewart and alleges that ai, appropriate penalty, as provided in Section 943.1395(7), Florida Statutes, shou Id be imposed for the reasons set forth above and in accordance with

the Election of Rights form (to which is attached an Explanation of Rights form) attached hereto and incorporated herein.
