The Criminal Justice Standards and Training Commission, hereinafter referred to as the Commission, files this Administrative Complaint against the Respondent, Jeffrey S. F0L111taine. The Commission seeks to impose disciplinary action upon the referenced individual based on the following allegations:

I. Respondent was certified by the Criminal Justice Standards and Training Commission on April 30, 1996, and was iSSLled Correctional Certificate Number 163972.

1. On or between December 12, 2009 and March 7, 2010, the Respo11,knt, Jeffrey S.

   Fountaine, did unlawfully obtain or use, or endeavor to obtain or use money 01· property valued at three hundred dollars ($300.00) or more, the property of a11other, to-wit: Clay Co\111ty Sheriff's Office, as owner or custodian thereof, with the i11te!1t to te111po1·arily or permanently deprive the owner or custodian of a right to the property, or a benefit therefrom, or to appropriate the property to his own use, or to the use of any person not entitled 1l1ereto.

2. The actions of the Respo11dc11t did violate the provisions of Section 812.014 or any lesser included offenses, Section 943.1395(7), Florida Statutes and Rule I lB-27.0011(4)(b), florida Administrative Code, in that Respondent has failed to maintain the qualifications established in Section

943.13(7), Florida Statutes, which require that a Correctional officer in the State of Florida have good moral character.

Florida Statutes and Rule 11 B-27.004(4), Florida Administrative Code. Any proceedings concerning this Complaint shall be co11ductcd pu.rsuant to Sections 120.569 a11d 120.57, Florida Stat<1tes, and Chapters l IB-27, 28-106, and 28-107, Florida A<lministrative Code. Mediation is not available under Section 120.573, Florida Stanttes.

WHEREFORE, it is alleged that the Responcle11t, Jeffrey S. Fou11taine is guilty of violating Sections 943.1395(7) a11d 943.13(7), Florida Statutes and Rule 11 B-27.0011(4)(b), Florida Administrative Code.

NOW, THERF.:FORE, the Florida Criminal .Justice Standards and Training Commission hereby complains against Jeffrey S. Fountaine and alleges that an appropriate penalty, as provided in Section 943.1395(7), Florida Statutes, should be imposed for the reasons set forth above and in accordance with the Election of Rights form (to which is attached a.n Explanation of Rights form) attached hereto and incorporated herein.
