HOWARD, 5 Respondent. } ADMINISTRATIVE COMPLAINT Petitioner, MARK T. PORTER, Superintendent of Schools of Monroe County, Florida, files this Administrative Complaint against James K. Howard (“Respondent”). Petitioner seeks termination of Respondent’s employment with the School District of Monroe County, Florida pursuant to Sections 1001.51, 1012.27(5), and 1012.33, Florida Statutes, Rule 6A-5.056 F.A.C, and Policies of the School District of Monroe County, Florida. In support herein, the Petitioner states as follows: JURISDICTIONAL BASIS 1. The agency is The School Board of Monroe County, Florida, located at 24! Trumbo Road, Key West, Florida 33040. 2. The Petitioner, MARK T. PORTER, is the Superintendent of Schools of Monroe County, Florida. His address is 241 Trumbo Road, Key West, Florida 33040. 1 3. The Petitioner, pursuant to §1012.27, Florida Statutes, has the authority to recommend to the School Board any school employee be suspended and/or diamissed fram employment. 4. The Respondent, JAMES K. HOWARD, has been employed with the District since July 3™, 2006. He is currently assigned as a plumber in the Maintenance Department. 5. Respondent is an “educational support employee” as defined by §1012.40(1)(a), Florida Statutes. His employment is governed by the collective bargaining agreement (“CBA”) between the School District of Monroe County, Florida and United Teachers of Monroe (“UTM”). Article V of the CBA provides that an employee may be disciplined, including termination for just cause. Under Article III, the School District of Monroe County, Florida reserves sole discretion to take disciplinary action against employees pursuant to its policies. 6. The Division of Administrative Hearings (“DOAH”), bas contractual jurisdiction over the parties and the subject matter of this Petition in the event Respondent requests a hearing on this matter pursuant to the CBA, Appendix A, Section 4, which provides that an employee may request a hearing before the School Board or the Division of Administrative Hearings and School Board Policy 4140 which refers to the procedure within the CBA. 7. The last known address of the Respondent, James K. Howard, is P.O. Box 1891, Key West, Florida 33041. | ADMINISTRATIVE CHARGES Petitioner, MARK T. PORTER, re-alleges the above and states as follows: 8. At ail times pertinent hereto, the Respondent was employed as plumber in thy Monroe County School District. 9. On June 10, 2014, Jeff Barrow, Director of Maintenance, met with Respondent, to discuss allegations that he violated School Board Policy, by, including but not limited to: poor attendance, failure to report and excessive absentecism. 10. School Board Policy 4430 LEAVES OF ABSENCE states as follows: A leave of absence is permission granted by the School Board or allowed under its adopted policies for an employee to be absent from duty for a specified period of time with the right to return to employment upon the expiration of leave. Support staff members shall not be absent from their assigned duties except as duly authorized, in advance, by the Superintendent. Leave for sickness or other emergencies may be deemed to be granted in advance if prompt report is made to the proper authority. Leave shall be used for the purposes set forth in the leave application. A support staff member who uses leave for purposes other than that set forth in the leave application may be subject to discipline, up to and including termination. A leave shail not be granted to any employee to accept other employment. Accepting employment while on a leave of absence cancels the leave automatically. The person on leave will be notified that s/he must return to work with the Board immediately, resign, or be terminated. Generally, no leave, except military leave or illness in line of duty leave, will be granted for a period in excess of one (1) year. Tiiness in line of duty leave may not be extended beyond the date 3 of maximum medical improvement, or a maximum of two (2) years from the date of injury, whichever is the earliest date, All leave shall expire no later than one (1) year from the date the approved begins, Automatic renewals of leave are not allowed. If leave is requested for more than one (1) year, the leave request shall require the Superintendent’s recommendation and Board approval. Leave may be with or without pay as provided by law, regulations of the State Board, and this policy. For any absence that is without pay, the deduction in compensation for each day of absence shall be determined by dividing the annual salary by the number of days/hours for the employment period. A. Paid leaves of absence may include: vacation, sick leave, personal charged to sick, jury duty/court service, illness or injury-in-line-of-duty, professional and military. B. Unpaid leaves of absence may include: professional study, personal leave not paid, iliness leave not paid, family and medical leave, maternity/adoption and child rearing leave Leaves of absence for bargaining unit members shall be provided in accordance with the collective bargaining agreement. 11. Respondent has violated School Board Policy 4430, as well as Article IX of the CBA by the following acts and omissions: a. Use of sick leave - failure to follow proper leave approval procedures. A verbal warning was given to Respondent on June 7, 2012 regarding his absences from work. A written warning was given to Respondent on July 13, 2012 (Exhibit “A”). August 2012 to January 11, 2013, Respondent was absent in excess of allowed sick/vacation, leave. See attendance records, January 11, 2013 Notice of Interview, and January 25, 2013 Memo of Interview attached hereto as Composite Exhibit “B,” January 25, 2013 to March 31, 2013, Respondent was absent for a total of 35 hours. Respondent bad a follow-up interview on April 5, 2013 concerning his poor attendance and improper notification when using leave. At this interview, it was noted that Respondent had been absent twelve (12) hours already for the month of April and that it was only the 5" day of the month. See April 16, 2013 Memo regarding April 5, 2013 interview with Respondeut attached hereto as Exhibit “C.” nterview - On October 3, 2013 a follow-up interview was conducted with Respondent for attendance and failure to follow proper leave procedures . It was noted Respondent’s average time missed over the last six month period of time was a day and a half per month. See attached follow-up interview notice and October 14, 2013 Memorandum attached hereto as Composite Exhibit “D.” 2014, Jeff Barrow, Director of Maintenance, had a meeting with Respondent to discuss his attendance. At that time, Respondent had missed eight (8) days in just a month’s time. After this meeting, Respondent was absent an additional three (3) days, which were noted ay not being properly requested by Respondent. See attached Memorandum and attendance: records attached hereto as Composite Exhibit “E.” 12. notes from Dan Martin, Maintenance Manager, to Respondent dated June 29, 2014 and July 1, 2014 attached hereto as Composite Exhibit “F.” 13. OnJuly 9, 20144 follow-up interview was conducted with Respondent. Seea copy of a note from that interview attached hereto as Exhibit “G.” 14. Onor about July 10, 2014, the School District of Monroe County, Florida sent Respondent a letter advising of their recommendation for suspension without pay (Exhibit “H”). 15. Pursuant to Florida Statutes and School Board Policies and Rules, on July 31, 2014, The School District of Monroe County, Florida sent written notice to Respondent advising that Respondent was suspended with pay. Further, Petitioner recommended termination of Respondent’s employment and advised Respondent of his right to request a hearing to contest the charges. That notice is attached hereto as Exhibit “T”. 17. Imsubordination - After the July 9, 2014 meeting respondent was informed that he should iimit meal times to 1 hour away from a work location, keep accurate daily logs and mileage logs. Exkibit “E”. 18. Subsequent to the meeting Respondent failed to follow the directive by spending excessive amounts of time at lunch, including over 2.5 hours on July 24, 2014 aloag with other instances of exceeding the allotted time on lunch break. 19. Inaddition mileage and work logs have not accurately reflected the time spent at work, including failing to note absences from work and logging time inaccurately. DEMAND FOR RELIEF 16. Petitioner, MARK T. PORTER, Superintendent of Schools of Monroe County, Florida recommends that the Monroe County School Board, after providing the requisite notice, terminate the Respondent, JAMES K. We discussed your last evaluations, verbal warning and written warming concerning this topic prior to this interview for the record. Copies of these Items are attached to this note. We discussed the number of days missed in January 2013 and the amount of hours which will be pay docked on the #114 pay run which will be for January 30” pay and for pay run # 115 which will be for the February 15” pay. A list of these days Is also attached to this note. You described dental work and complications as being the cause for your attendance problems. We explained that the problem has been on-going as demonstrated by your leave balance coming into January. At this point you are completely out of all leave and are being docked for the days and hours you missed. During January alone there are over ten instances where you needed to leave work. Some were for Iliness and some were for personal business. This Is very excessive and did not in all cases follow the proper notification process. The use of leave and notification must follow the rules established In the UTM contract. A copy of article 9 is attached noting areas that must be improved. Jenuary 11° 2013, James Howard was put on notice there would be an Interview for the record would be done In the maintenance office over his poor attendance and lack of proper leave procedures. 4. January 25" 2013, Interview for the record was conducted In the maintenance office with James Howard and his representative from the U.T.M. Helly Hummel- Gorman. We discussed poor attendance and leave procedures not belng followed properly and advised James that we would have a follow up review In April, 5. April S™ 2013, Follow up for interview for the record which took place on January 25” 2013, with James Howard and his representative from the U.T.M. Holly Humme/— Gorman at this meeting we advised James that his attendance was unacceptable. He has missed 35 hours from January 25, 2013 until March 31, 2013 and In this month of April you have missed 12 hours and this ts only the fifth day of the month. We Informed Mr. Howard it would be noted In his annual review that his attendance would reflect unacceptable, we also discussed If improvement was not seen by our next scheduled follow up on July 18” 2013, we would be recommending disciplinary actions up to suspension for one day without pay. Statement of Problem it Is our opinion that even though your attendance Is somewhat better there has not been a significant Improvement in the problem at hand with your absenteelsm and following the guide IInes for applying for your leave. You have missed thirty five hours from Jan.25” to March 31° and this does not include time missed this month, On one occasion you clocked in on Feb.25" 7:17 am and never clocked out for the day | was looking for you Inthe afternoon and another employee told me you had left in your personal vehicle about 1:30 that aftemoon but when you turned in your daily lag sheet you showed working a full eight hours. ! personaily think this Is no more than a case of forgetting to property fill out your dally log form since it sometimes seems iike it takes you as long as a week before you turn In your log sheets and for that reason we will not do an Investigation. During the follow up interview you mentioned you had a part time Job and you were working an eight hour shift in the evening es well as working an eight hour workday here and it sometimes takas a toll on you. | would not want to see your part time job (nterfere with your Job here. There Is a Board Policy that refers to part time work saying that no District officer or employee, Including but not fimited to Board Member, and Instructional staff members, or support staff members, shail have or hold any employment or contractual relationship that would conflict whatsoever between his/her private interest and performance of his/her duties. Prior Discussions and /or Disciplinary Actions Taken Only verbal and written warnings preceded this follow up meeting of April 5" 2013, but from this meeting we informed Mr. Howard along with his representative Holly Hummel— Gorman from the U.T.M. that we intend to reflect that Mr. Howard’s attendance Is unsatisfactory and will be listed on his annual employee review. if improvement has not been made before our next follow up meeting scheduled for July 18" 2013, we will be recommending disciplinary actions up to suspension for one day without pay. Objective of improvement Vacation Time: All vacation leave used will follow the U.T.M. contract language of five day prior notification. This shall be documented on the leave report form. During this revaluation period no sick leave shall be used without backup documentation. James Howard Is a person of skills and knowledge vital to the operation of the maintenance department and | know he Is capable of performing the task at hand if he is here to do it. We want you to make your attendance your number one priority in the future. Having reviewed all of the Information combined with the Inconsistencies In your reporting we believe we may have identified @ need for corrective acticn. Because of the serious nature of this problem and In light of your past history with problems of this nature, | will be requesting from Dr. Dawkins, a three day suspension and enforcement of the requirement for the provision of a doctor's note after sick leave has bean requested and used. If the time you are out exceeds your 15 minute break you will be asked to fill out a leave form. © Mealtime must be limited to 1 hour away from the work location. Breaks must be limited to 15 minutes away from your work location. ® Mileage logs, dalty log sheets, and completed work orders shall be promptly done each day describing where you want and the work you performed. These are due at the end of each work day. © Try to schedule personal appointments outside of your work day. This will help you conserve you sick days. ® Finally, please take a moment to review Article IX In your SRP contact on attendance requirements, lappreciate your commitment to the work we do and your expression of this as the last meating. However, to ensure you have corrected this Issue, we are scheduling a follow up meeting. The follow- up meeting will be held on October 9, 2014 at Ipm to review your progress. The location will be In the Key West Maintenance office. You have the right to. a witness or UTM representation during this meeting should you desire to have one present. Failure to correct your attendance Issues by that time may result in disciplinary actlons up to and Including suspension, demotion, or termination.
