Comes now, the Division of Alcoholic Beverages and Tobacco, herein after referred to as
“petitioner,” and files this administrative complaint against LIQUOR GROUP FLORIDA LLC herein
after referred to as “respondent,” and alleges:

Petitioner is the state agency charged with supervising businesses licensed under the
Florida beverage, tobacco and tax, and tobacco products permit laws pursuant to
sections 559.061, 561.07, 561.15, 561.19, 561.29, 561.501, 210.15, 210.16, 210. 45,
210.50, 569.003, and 569.006, Florida Statutes.
Respondent is, and has been at all times material hereto, the holder of a valid
license/permit, issued in the State of Florida, by the Division of Alcoholic Beverages
and Tobacco. Respondent's last known mailing address is as follows:

And the division has not been notified of any other designated person or address for

Petitiorier intends to revoke; suspend; annul; impose civil penalties, investigative
costs, and late penalties; or any combination of these authorized penalties. This
intended action is based on the below described facts or conduct.

You, LIQUOR GROUP FLORIDA LLC, D/B/A LIQUOR GROUP FLORIDA LLC, are charged with the
~ following count(s):
1, On or about 05/25/2012 and 06/01/2012, you, the aforementioned licensee, holding a license
under the Beverage Law, or your agent(s), officer(s), servant(s), or employee(s), or other person(s)
to wit: Christopher John Eiras, did unlawfully on your licensed premises or elsewhere while in the
scope of employment, remove, deposit, or conceal; alcoholic beverages, to wit: (57) 55 Gallon
Barrells of Happy Vodka, Happy Rum, and Happy Gin; Concealed the licensed premises
storage Unit #24, Additional inventory in Unit # 33 of the warehouse, on which the Florida
excise tax has not been paid, with intent to defraud the state of such tax or any part thereof, this act
being contrary to and in violation of section 562.32, within 561.29(1)(a), Florida Statutes.
2. On or about 06/01/2011,10/04/2011, 11/01/2011, 01/01/2012, 02/01/2012, 03/01/2012,
0501/2012, and 06/01/2012, you, the aforementioned licensee, holding a license under the
" Beverage Law, or your agent(s), officer(s), servant(s), or employee(s), to wit: Christopher John
Eiras, did unlawfully on your licensed premises or elsewhere while in the scope of employment,
willfully and knowingly making false entries into records required under the Beverage Law, to wit:
Monthly Liquor and Wine Reports, this act being contrary to and in violation of section 562.45(1),
‘within 561.29(1)(a), Florida Statutes.
3. On or about 06/01/2042, you, the aforementioned licensee, holding a vendor license under the
Beverage Law, did fail to display your license in a conspicuous place on the licensed premises, this
act being contrary to and in violation of section 561.23(2), within 561.29(1)(a), Florida Statutes.
4. On or about 06/01/2012, you, the aforementioned licensee, holding a license under the Beverage
Law, or your agent(s), officer(s), servant(s), or employee(s), to wit: Christopher John Ejras, while in
the scope of employment, did unlawfully keep or store alcoholic beverage, to wit: Large Quantites
of Assorted Brands of Liquor, refer to case report, in a building or room not part of the licensed
premises and which was not issued an ‘off-premises storage permit by the Division of Alcoholic
Beverages and Tobacco, this act being contrary to and in violation of section 562.03, within
561.29(1)(a), Florida Statutes. :
5, On or about 06/15/2012, you, the aforementioned licensee, holding: a license under the’ Beverage
. Law, did fail to respond and comply with a subpoena issued on 06/01/2012 by failing show up in
person at the designated location on the designated date and time indicated on such subpoena, this
act being contrary to and in violation of section 561.29(2), within 561.29(1)(a), Florida Statutes. .

6. On or about 03/21/2011, you, the aforementioned licensee, holding a license under the Beverage
Law as a manufacturer, distributor, or exporter did unlawfully obtain inventory from Provectus
‘Imports not-owned by the distributor and held the inventory on consignment, to wit: 700 cases of
750 mi bottles of Plain Binboa Vodka, 500 cases of 750 mi bottles of Satsuma Binboa Vodka,
500 cases of 750 ml bottles of Red Orange Binbos Vodka and 500 cases of 750 ml bottles of
Red Apple Binboa Vodka, this act being contrary to and in violation of section (s) 561.41 1(2)(b),
within 564 ,29(1)(a), Florida Statutes.
