PINELLAS COUNTY CONSTRUCTION LICENSING BOARD PINELLAS COUNTY CONSTRUCTION LICENSING BOARD Case #: A15-686 Petitioner, vs CLIFF JERE DAVIS LICENSE #:I-CBC060284 Respondent, / ADMINISTRATIVE COMPLAINT COMES NOW, the Petitioner, Pinellas County Construction Licensing Board, hereinafter referred to as “Petitioner”, and files this Administrative Complaint against CLIFF JERE DAVIS, hereinafter referred to as “Respondent”, and alleges: 1. Petitioner seeks to suspend, revoke or take other disciplinary action against the Respondent as licensee and against his license to practice contracting pursuant to Chapter 75-489, Laws of Florida, as amended. 2. Respondent is a Building Contractor, having been issued license |-CBC060284 (CBC060284). Respondent’s address of record is PO Box 2297, Pinellas Park, FL 33780. 3. Atall times, material Respondent was the qualified as an individual. COUNT ONE 4, Respondent of Florida First Development Corp entered into a subcontract agreement with ABM Stucco Inc on September 25, 2006 to stucco ten buildings with a total of 52 units at 4250 71° N, St. Petersburg, FL. ABM Stucco Inc completed six of the buildings then Respondent breached the contract by having another subcontractor complete the remaining four buildings. 5. Respondent previously qualified Florida First Development Corp and was sole officer of the corporation. Records show that Respondent allowed the corporation to become Inactive as of September 28, 2012 and dropped the company name from his license in 2010 or 2011. 6. Acourt judgment (case # 07-9472-CI-11) in favor of ABM Stucco Inc in the amount of $50,495.00 plus 6% a year was signed March 23, 2010. Respondent failed to satisfy the judgment. 7. Failure to satisfy within a reasonable time, the terms of a civil judgment obtained against the licensee, or the business organization qualified by the licensee, relating to the practice of the licensee’s profession is a violation of Section 489.129 (1)(q), Florida Statutes; and Section 24 (2)(m), Chapter 75-489, Laws of Florida, as amended. 12600 Belcher Road, Suite 102 e Largo, Florida 33773 e Phone 727-582-3100 e Fax 727-453-3523 Web Site: www.pcclb.com PINELLAS COUNTY CONSTRUCTION LICENSING BOARD COUNT TWO 8. Paragraph 1 through 7 restated as if in full. 9. Respondent committed financial mismanagement or misconduct in the practice of contracting that caused financial harm to a customer in violation of Section 489.126 (2) & (4), Florida Statutes; Section 489.129 (1)(g), Florida Statutes; and Section 24(2)(h), Chapter 75-489, Laws of Florida, as amended. WHEREFORE, Petitioner requests that an order be issued imposing one or more of the following penalties: suspension or revocation of Respondent's license, imposition of an administrative fine, financial restitution to the consumer for financial harm directly related to the violation, and assessment of costs related to the investigation and prosecution of the case, and any other relief that is deemed appropriate.
