FINAL ORDER

THIS CAUSE came before the State of Florida, Agency for Health Care Administration ("the Agency") concerning the preliminary approval of Certificate of Need 10451 filed by Central Florida Health Services, LLC ("Central Florida") to establish a 100 bed general acute care hospital respectfully, with respect to District 7-2

1. On December 2, 2016, the Agency issued its decision regarding the preliminary approval of CON 10451.

2. On December 23, 2016 , Adventist Health System/Sunbelt, Inc., d/b/a Florida Hospital ("Florida Hospital") filed a Petition for Formal Administrative Hearing challenging the Agency ' s preliminary approval of Central Florida's CON No. 10451.

3. The Agency referred the Petition to the Division of Administrative Hearings and an Administrative Law Judge ("ALJ") was assigned.

4. On July 12, 2017, Florida Hospital filed a Notice of Voluntary Dismissal voluntarily dismissing its Petition for Formal Hearing against Central Florida with prejudice.

5. No other cases challenging are pending as to the approval of CON 10451 filed by

1. The approval of CON 10450 is UPHELD. The Agency shall issue CON 10451 to Central Florida.

NOTICE OF RIGHT TO JUDICIAL REVIEW

A party who is adversely affected by this Final Order is entitled to judicial review, which shall be instituted by filing the original Notice of Appeal with the Agency Clerk of AHCA, and a copy along with the filing fee prescribed by law with the District Court of Appeal in the appellate district where the Agency maintains its headquarters or where a party resides.
