FINAL ORDER


THIS CAUSE concerns both a request for an informal hearing ("Request") and a Petition for Formal Hearing Involving Disputed Issues of Material Fact ("Petition") that Respondent filed with the Agency Clerk's Office in response to the Agency for Health Care Administration ' s ("Agency") October 11, 2016 Final Audit Report (Exhibit A).

The case was referred first for an informal hearing in October of 2016, and then for a formal hearing in March of 2017 after Respondent raised disputed issues of material fact while the matter was pending before an administrative law judge.

On September 27, 2017, Respondent filed a Notice of Voluntary Dismissal with Prejudice (Exhibit B), dismissing both the Request and the Petition.

Based on the foregoing,


IT IS THEREFORE ORDERED AND ADJUDGED THAT:


Respondent's Request and Petition are hereby dismissed with prejudice , and the Agency's October 11, 2016 Final Audit Report is hereby upheld as final. The parties shall govern themselves accordingly .

Unless payment has already been made, payment in the amount of $674,044.89 is now due from Respondent as a result of the agency action.
