COMES NOW, the Petitioner, Pinellas County Construction Licensing Board, hereinafter referred to as
“Petitioner”, and files this Administrative Complaint against NATHAN DUTCHER, hereinafter referred to
as “Respondent”, and alleges:
1. Petitioner seeks to suspend, revoke or take other disciplinary action against the Respondent as
licensee and against his license to practice contracting pursuant to Chapter 75-489, Laws of
Florida, as amended.
2. Respondent is a General Contractor, having been issued license |-CGC1512764
(CGC1512764.) Respondent's address of record is 654 100th Ave N., St Petersburg, FL 33702.
3. At all times, material Respondent was the qualifying contractor for Point Residential LLC.
4. On March 28, 2016 the Respondent entered into a written contract with the Complainant for
demolition and remodel of her mobile home, to include new floors, kitchen, bathroom, all
fixtures, walls, baseboards, counters, and the construction of a new utility shed for a total cost of
$29,550.00. Complainant stated that Respondent did not obtain required permits and that she
paid him one payment of $16,000.00 before she realized what a disaster it was and paid him no
more. He left her home in a terrible, unfinished condition

Defendant obtained required permits.
6. Respondent failed to obtain a building permit prior to the start of construction as required in
violation of Section 104, Florida Building Code 5" Edition (2014) - Building; Section 489.127
(1)(h), Florida Statutes; Section 489.129 (1)(0), Florida Statutes; Section 24(2)(n), Chapter 75-
489, Laws of Florida, as amended; and Pinellas County Code, Section 22-14.

appropriate.

2/22/12---Mr.Rocha, the complainant, says he contracted with Nathan Dutcher (Point Residential LLC
CGC1512764) to perform some repairs. There was no contract supplied with this complaint against Mr.
Dutcher. The work is allegedly Fascia and Soffit work. The total price was $2500, and a $1250 deposit was
given to Point Residential LLC on 12/14/11 (check # 1387, supplied). Mr. Rocha states there were many false
start dates that passed. Finally, on 1/10/12, Mr. Dutcher showed up. The complaint sounds like he had a sub
contractor with him. Allegedly, some minor work was performed by Mr. Dutcher of putting up some fascia with
8 screws. It appears Mr. Rocha then fired Mr. Dutcher, hired another contractor, Jeffrey Christopher Neal (I-
CGC062069) to perform the work at a cost of $2450. Mr. Neal pulled the required permit.
Mr. Rocha also alleges he gave Mr. Dutcher, an unspecified amount of money for supplies.
It appears Mr. Dutcher s registration in Pinellas County was expired at the time of this project. It had
expired 10/1/11, as it has not been renewed. It was in expired status the date the check was written (12/14/11).
Mr. Rocha wants his $1250 deposit back from Mr. Dutcher.

8/17/12---The complainant, Tami L. Horsky, is filing this complaint for Stacey Hudspeth
Ms. Horsky states: On 6/16/12 on Craigs List, she responded to an ad for a 4 point inspection that is
required for insurance coverage on Ms. Hudspeth s SFR at 6499 18th St N St Pete. Mr. Dutcher told her the
cost is $100. On 6/14/2012, the inspection was performed. While at that address, Mr. Dutcher mentioned to
Ms. Hudspeth that she should have a Wind Mitigation report done which will save her more on the insurance.
He told Ms. Hudspeth the cost is $50 since he is already there. She paid the $50 in cash. The report was sent
by e mail on 6/14/12, with a note saying the Wind Mitigation report will follow by US Mail . Ms. Horsky says
that report never came. On 6/25/12 an e mail was received saying that Mr. Dutcher charges $125.00 for that
report. And since the additional $75.00 was not received, his office did not send the report.
The complainant says the verbal agreement was for the two reports to be $150.00. Mr. Dutcher allegedly
wants an additional $75.00 + an additional $25.00 for the 4 point inspection, or a total of $275.00 for the two
reports. He has been paid $150.00.
There was a problem with the 4 point inspection report. When notified of the problem, its alleged Mr.
Dutcher refused to correct the report unless the additional money is paid to him. The complainat feels
victimized, and that this is a con. The reports, at this point, are not as important as informing others of Mr.
Dutchers business practices.
9/11/12---The Probable Cause Committee found no PC, as this is a contract dispute that would need to be
resolved in civil court. Case closed.

Nathan Dutcher was hired to do repairs and new construction of a shed on my mobile
home. Original estimate was for $29.550 with a deposit paid to him for $16,000.
On the first day of work he brought in a crew that he found on craigslist that were not
licensed or insured for the demo of the floors and to put in new sub floors. These people
were not supervised and proceeded to tear out and throw away wood baseboards,
tearing and damaging newly painted walls. The main bathroom was not finished
because it had black mold. Everything was taken out, tub, toilet and sink to replace the
sub flooring. They returned the next day to haul off the carpet, baseboards and trash.
Nathan and his brother took out the kitchen cabinets and did the sub flooring there. The
following week another crew from craigslist showed up to work on the bathroom, again
unsupervised, unlicensed and uninsured.

Their job was to finish the bathroom. They started the dry wall which was hung poorly, making huge
holes for the shower and tub faucet. They installed the tub without securing it properly. They did not
hook up the plumbing nor check or replace any of the plumbing to look for leaks. They did not return.
Craigslist crew #3 came and worked on the bathroom. They also did such a poor job Nathan fired them.
Apparently he did not pay them either because the one man showed up several days later looking for his
money. | believe at this point we are into week 3. The bathroom at this point is completely torn out. He
hired a contractor to do the tile (which | provided) and the contractor would not take Nathans dirty
money. So | had to pay him. He also had to go into the wall from the bedroom to do all the repairs to the
shower/tub... secure it and replumb. | had to purchase new cabinets ,plumbing parts and fixtures since
crew #1 threw everything away. As of today the bathroom Is still not finished. No sink, no toilet, no
shower.
Nathan did such a poor job, not showing up, not supervising that | started to take away the unstarted
jobs from him. He was to install new windows. | bought the windows myself and will hire a new
contractor to install them for half of what he was going to charge me. He had no intention of installing
them, he never went before the HOA for approval nor did he ever pull permits. He never got permission
from the HOA to replace the one window with a door... nor permit.
The kitchen... he took out all the cabinets and replaced the sub flooring. He put the cabinets back... some
drawers barley open and the breakfast bar was torn out and not finished. No kick plates. The sink area
was to have new wood put in as there are giant holes in the walls and floor, which was not done either.
Nathan ordered granite for me with only showing me samples online. Any good contractor would have
me pick out the slabs in person. He had someone from Orlando area come and install the granite. Again,
he was not here to supervise. The granite was the wrong color and wrong size in the kitchen. The 2
bathroom pieces were the wrong size and the wrong colors. The granite men took the 2 bathroom slabs
back out and said they would replace them. I never saw them again and when | talked to them they said
| had to pay them again for the new granite. They also told me Nathan told them he could use them at
another house. So | expect to be repaid for them so | can buy new, either that or this is theft. Now |
have a kitchen that is still torn up with granite | hate and does not fit. | have no sinks in the bathrooms. |
had to have someone come in and install the faucets in the kitchen sink as Nathan never showed up to
install them. | also had to have someone else come install the kitchen appliances as Nathan never came
back to do that either.
Nathan said he would repair and patch walls damaged. This was not done. He said he would reinstall
water heater. This was never touched, not evento replace the sub flooring under it as he was suppose to
do the entire house. This was a critical area that was neglected.
Nathan agreed to put down vinyl flooring. He charged me $3850. Then he said he did not want to do it
himself and he would need to hire someone. So my son agreed to do it for him for $1700. He proceeded
to lay the flooring and then Nathan refused to pay him. Nathan told me to pay him, which | did not do.
Nathan hired him and Nathan should pay him out of the $16,000 he was given. The agreement for my
son to do the work was between my son and Nathan. | asked Nathan why he did not finish the kick
plates on the kitchen cabinets and he told me that was the flooring guys job. The kick plates were not
part of any agreement with my son when he agreed to do the flooring. | asked Nathan about the base
boards. | expect him to replace them since he allowed the craigs list crew #1 to tear them out and throw
them away. Nathan said he would not pay for them nor would he install them.
He has not been back in 3 weeks. | called him to come finish and he told me he had no time and no
money for this job any more. He also said he only made $2000 on this job and he lost 3 weeks of his life.
He has clearly abandoned me and the job. We are living in a torn up house, myself a senior on disability,
an adult student and an 18 month old baby. Since Nathan clearly abandoned the job and me | will have
to hire someone else to finish all the jobs he did not finish and my family has to live in chaos. He refuses
to refund me any part of the $16,000 that he was given and now | don’t have the money to do the jobs
that needed to be done here to make my new home livable. There is not one job that Nathan was hired
for that was finished. He refused to take my calls these last few weeks and did not return my calls.
Clearly job abandonment when he said he had no more time for this job nor any more money for this
job.
Every other day he revised his estimate. | believe that he misallocated the funds. He took me for a
foolish old woman.
The jobs that were taken away from him when he wasn’t showing up and | saw his indifference was the
shed, the windows, the sub panel, the back door & the back splash in kitchen.
| invite your inspectors /investigators to come and look at the unfinished work and how he has left this
house for us to live in chaos.

THE SPECIFIC COMPLAINT IS: (Attach additional sheets as

Nathan Dutcher was hired to do repairs and new construction of a shed on my mobile
home. Original estimate was for $29.550 with a deposit paid to him for $16,000.
On the first day of
the demo of the floors and to put in new sub - These people,

tearing and damaging newly painted walls. The main bathroom was not finished
because it had black mold. Everything was taken out, tub, toilet and sink to replace the
sub flooring. They retumed the next day to haul off the carpet, baseboards and trash.
Nathan and his brother took out the kitchen cabinets and did the sub flooring there. The
following week another crew from craigslist showed up to work on the bathroom, again
unsupervised, unlicensed and uninsured.
