This matter comes before the Department of Highway Safety and Motor Vehicles for entry of a final order upon submission of the Recommended Order issued December 10, 2019, by the Honorable Hetal Desai, Administrative Law Judge of the Division of Administrative Hearings, a copy of which is attached and incorporated by reference in this order. None of the parties having filed exceptions to the Recommended Order, and having reviewed the Recommended Order, transcript, exhibits, and the complete record of the proceeding, and being fully advised in the premises, it is ORDERED and ADJUDGED that:

  1. The Findings of Fact, Conclusions of Law, and Recommendation contained in the Recommended Order are ADOPTED IN TOTO;

  2. The Department finds that the Petitioner failed to meet its burden of establishing standing; and

  3. Accordingly, the petition is DISMISSED and the case is CLOSED.

If all other requirements for licensure are met, the Bureau of Dealer Services may issue a license for the proposed establishment of West Coast Outdoor Sports, LLC d/b/a Gables Motorsports Wesley Chapel as a franchise dealership for the sale of motorcycles manufactured by Vanderhall Motor Works, Inc. (line-make VAND).
