BEFORE THE SCHOOL BOARD OF MARION COUNTY, FLORIDA CASE NO. 19-009 DR. HEIDI MAIER, Superintendent of Schools, Petitioner, vs. KERRI BRADLEY, an employee of the Schoo] Board of Marion County, Respondent ADMINISTRATIVE COMPLAINT Petitioner, Dr. Heidi Maier, Superintendent of Schools (“Petitioner”), files this Administrative Complaint against Kerri Bradley (“Respondent”), an employee of the School Board of Marion County (hereinafter referred to as SBMC), and alleges as follows: 1; Respondent is an instructional employee and is currently employed as a teacher at Belleview-Santos Elementary School. 2. On December 13, 2018, the Marion County School District received a complaint alleging that Respondent had provided assistance outside the scope of what is allowable in a standardized testing situation to two (2) students during a Quarterly Standards Mastery Assessment (QSMA) by answering test questions during the math portion of the assessment. 3: Specifically, it was alleged that Respondent’s Paraprofessional overheard Respondent assisting students and providing them with direction during the assessment. 4. An investigation was conducted by Tyson Collins, Administrator on Assignment, Equity Assurance. 5. Principal Ashley Kemp obtained statements from the two students, who indicated that Respondent had in fact provided them with assistance during the test. 6. As a result of the acts described above, Respondent violated State Board of Education Rule 6A-10.042 Test Administration and Security; as well as School Board Policy 6.270, Professional Ethics and School Board Policy 4.61, Security of Test; and Florida Administrative Code 6A-10.081, Principles of Professional Conduct for the Education Profession in Florida. 7. It should be noted that these types of testing violations have been identified as an area of particular concern by the Department of Education Professional Practices Services and that educators are routinely sanctioned for these types of testing infractions. 8. Respondent’s conduct constitutes misconduct in office and just cause for discipline. 9. Accordingly, Petitioner recommends that the School Board issue a ten (10) day unpaid suspension to Respondent. 10. This level of discipline is warranted under the circumstances and is consistent with the School Board’s discipline issued in previous testing violation infractions. WHEREFORE, for the foregoing reasons, the undersigned Superintendent recommends that the Respondent be given the discipline outlined above, effective on the date the recommendation is acted upon by the SBMC. bid! mas.
