ORDER


The Florida Fish and Wildlife Conservation Commission ("Commission") hereby enters the following Order. This matter involves a determination by the agency that Petitioner's vessel was derelict. Petitioner challenged a Notice of Derelict Vessel and Intent to Destroy Said Vessel issued to the Petitioner on January 9, 2020.

This cause comes before the Commission pursuant to an Election of Rights and Petition for an Administrative Proceeding requesting an administrative review of the denial.

The case was originally referred to the Division of Administrative Hearings ("DOAH") for assignment of an ALJ. Based upon additional evidence provided by the Petitioner, it was decided between the parties that the Petitioner was not responsible for the derelict vessel.

Further, the Commission located the responsible party and will not take any further action against the Petitioner related to the derelict vessel.

Accordingly, the parties submitted a Joint Motion to Dismiss. That motion was GRANTED.

The matter was dismissed and closed by DOAH on May 19, 2020, and jurisdiction was relinquished back to the agency.

This matter is hereby dismissed.
