BEFORE THE SCHOOL BOARD OF MARION COUNTY, FLORIDA CASE NO. 20-012 DR. HEIDI MAIER, Superintendent of Schools, Petitioner, vs. WILLIAM CHARTRAND, an employee of the School Board of Marion County, Respondent ADMINISTRATIVE COMPLAINT Petitioner, Dr. Heidi Maier, Superintendent of Schools of Marion County (hereinafter referred to as “Petitioner’”), files this Administrative Complaint against WILLIAM CHARTRAND (hereinafter referred to as “Respondent’’), an employee of the School Board of Marion County (hereinafter referred to as SBMC), and alleges as follows: 1. Respondent is a Fifth Grade Teacher with SBMC and is currently employed as such with College Park Elementary School. 2. On March 9, 2020, it was reported that the Respondent was arrested on criminal charges of: A. Felony Battery- Domestic Battery by Strangulation in violation of 784.041(3), Florida Statutes on March 8, 2020. 3. Respondent was provided notice of the allegations and placed on Administrative Leave with pay, pending finalization of the criminal law allegations made against the Respondent. 4. §1012.465, Florida Statutes, requires instructional school district employeeswho are permitted access onschool grounds or who have direct contact with students to meet Level 2 screening requirements. 5s Level 2 screening requirements, which are set forth in §435.04, Florida Statute, require the School District to ensure that no employee has been arrested, or is awaiting final disposition of charges, under §784.041-3, Florida Statutes. 6. §435.06(2)(b), Florida Statutes, states that if an employer becomes aware that an employee has been arrested for such a disqualifying offense, the employer must remove the employee from contact with any vulnerable person until the arrest isresolved in a way that the employer determines that the employee is still eligible for employment. WHEREFORE the undersigned Superintendent hereby recommends that Respondent be placed on administrative leave without pay from his employment effective on the date this recommendation is acted upon by the School Board of Marion County until such time as either his employment is terminated or he is eligible to be permitted access on school grounds. byide oo Heidi Maier, Ed.D.
