Izzadeen Academy (9350) ~ Agency Case Number: DOE-2021-3985 Izzadeen Academy (9350) is a private school participating in the Florida Tax Credit Scholarship Program (FTC), the John M. McKay Scholarship for Students with Disabilities Scholarship Program (McKay), the Gardiner Scholarship Program (Gardiner), the Family Empowerment Scholarship Program (FES) and the Hope Scholarship Program (Hope), providing services to eligible students pursuant to sections 1002.395, 1002.39, 1002.385, 1002.394, 1002.40 and 1002.421, Florida Statutes. It is the Commissioner’s intention to immediately suspend all scholarship payments and revoke Izzadeen Academy’s eligibility to participate in FTC, McKay, Gardiner, FES and Hope for the following reasons: 1. Fraud: During the 2020-2021 school year, Izzadeen Academy claimed Florida Tax Credit Scholarship funds for students Aisha Agha, Farah Agha, Fatimah Agha and Khadija Agha, the minor children of Wafaa Alkhateeb, the school’s owner of record with the Florida Department of State, Division of Corporations and the Florida Department of Education. However, in order to claim scholarship eligibility for her children, Ms. Alkhateeb has previously executed affidavits stating that neither a parent nor guardian of the children is an owner or operator of Izzadeen Academy, thereby committing fraud as contemplated in section 1002.421(3)(d)(3), Florida Statutes. Section 1002.421(3)(d), Florida Statutes, provides that the Commissioner may suspend, revoke or immediately suspend a school’s scholarship participation if there is cause to believe that there is fraudulent activity on the part of the school. Pursuant to the Commissioner's authority described in section 1002.421(3), Florida Statutes, Izzadeen Academy’s eligibility to participate in FTC, McKay, Gardiner, FES and Hope is hereby immediately suspended. Further, it is the Commissioner’s intention to revoke Izzadeen Academy’s eligibility to participate in FTC, McKay, Gardiner, FES and Hope. www.fidoe.org 325 W. Therefore, Izzadeen Academy is to return $20,409.00 in FTC Scholarship funds to Step Up for Students. NOTICE OF RIGHT TO APPEAL Pursuant to sections 120.569, 120.57, and 1002.421(3)(c)(2), Florida Statutes, you are entitled to dispute this decision through legal administrative procedures and to be represented by counsel or other qualified representatives. If you wish to do so, you must make a written request for an administrative hearing in accordance with the provisions of Chapter 28-106, Florida Administrative Code. The written request must be received by the Department’s agency clerk within 15 calendar days of the date you receive this letter. The written request must be submitted to: Chris Emerson, Agency Clerk Department of Education 325 West Gaines Street, Room 1520 Tallahassee, Florida 32399-0400 If the written request is not received by the Department within 15 days of receipt of this letter, you will waive the opportunity to contest the decision through administrative proceedings and the Commissioner of Education will issue a final order, subject only to judicial review pursuant to section 120.68, Florida Statutes.
