While I am unable to subscribe to the reasons offered for the reversal, as set forth in the opinion of Mr. Justice BUFORD, I am convinced that the bill of complaint contains equity and the lower court erred in sustaining the motion to dismiss. I agree to the conclusion that the order appealed from should be reversed for further proceedings in the lower court. *Page 395
