Summary: In October, 1941, the grand jury for Hillsborough County filed a report in the Circuit Court in which it made findings of fact and recommended to the Governor that Hardy C. Graves, a constable in District Three of said county be removed from office. Graves promptly moved to expunge the report from the record. His motion was overruled; hence this appeal. It is my opinion that the case is not properly before this Court but a majority of the Court having a contrary view I concur in the opinion of Mr. Justice TERRELL.
