I concur in the affirmance, but it seems that more complete justice might be accomplished if the special interest of each of the parties be determined, see Chapter 78, F.S. 1941, F.S.A.; Thompson v. Guntner, Fla., 36 So. 2d 826, as well as questions of priority of claims between the parties. However, this may depend upon the pleadings.
