Section 16 of Article 9 of the Constitution and our adjudications place the power with the State Road Department to designate a State Road within a county upon which gasoline funds of the county may be expended, rather than with the Board of County Commissioners of a county. This rule in controlling, in my opinion, absent a showing of abuse of discretion on the part of the State Road Department. *Page 689
