This matter comes before the Court on Plaintiff Capital Solutions Bancorp LLC and Defendants Cleaning Services, Inc. and Carlos Castillo Stipulation for Dismissal With Prejudice of Defendants Denver Cleaning Services, Inc. and Carlos Castillo Only (Doc. #46) filed on December 11, 2015. Under Rule 41(a)(2) of the Federal Rules of Civil Procedure, "an action may be dismissed at the plaintiff's request only by court order, on terms that the court considers proper." Here, Plaintiff and Defendants Cleaning Services, Inc. and Carlos Castillo stipulate to dismiss with prejudice all claims, counterclaims, and third party claims that were brought, or could have been brought, in this action; and they further stipulate to each party bearing its own attorneys' fees and costs. (Doc. #46). The stipulation does not affect the claims between Plaintiff and Defendant MillerCoors, LLC.
The Court, therefore, dismisses this case as between Plaintiff and Defendants Denver Cleanings Services, Inc. and Carlos Castillo under Rule 41(a)(2).
Accordingly, it is now
