IT IS ORDERED:
The report and recommendation is accepted and adopted as this Court's opinion.
Defendant's motion to dismiss, ECF No. 14, is GRANTED. The Clerk shall enter judgment stating, "The federal claims in Plaintiff's complaint are DISMISSED for failure to state a claim upon which relief may be granted pursuant to 28 U.S.C. §1915(e)(2). Plaintiff's supplemental state claim is DISMISSED without prejudice. This Court declines to exercise its supplemental jurisdiction pursuant to 28 U.S.C. §1367(c)." The Clerk shall close the file.
