Before me is the Motion for Seal of Entire Matter (Doc. 9).
This case is a False Claims Act case brought pursuant to 31 U.S.C. § 3729 et seq. On September 3, 2014, pursuant to the procedures outlined in 31 U.S.C. § 3730, I granted the Plaintiff's motion to file the complaint under seal, and subsequently extended the time that the complaint may remain under seal.
Plaintiff now asks that the entire matter be sealed, not just the complaint. 31 U.S.C. § 3730 states that the "complaint shall be filed in camera, shall remain under seal for at least 60 days." 31 U.S.C. § 3730(b)(2) (emphasis added). It further references the "time during which the complaint remains under seal," and the period "after the complaint is unsealed." 31 U.S.C. § 3730(b)(3) (emphasis added).
In support of its motion to seal the entire proceeding, not just the Complaint, Plaintiff states only that "it is well established that the entire matter be sealed not just the Complaint." The motion cites no authority in support of this conclusory statement.
In an abundance of caution, I will seal the entire matter temporarily. In order to extend the seal further, Plaintiff must file a motion that adequately explains the legal basis for sealing the entire matter.
