Accordingly, the Court ADOPTS the Report and Recommendation of the Magistrate Judge as its opinion, DENIES AS MOOT Plaintiff's motion for hearing (doc. no. 16), and GRANTS the Commissioner's partial motion to dismiss (doc. no. 11).
