DEFENDANT GUZMAN-CORDOBA'S MOTION TO SEVER
TANYA WALTON PRATT, District Judge.
The defendant, Angelica Guzman-Cordoba, by counsel, Belle T. Choate, moves the Court to sever her case from the other Defendants in this matter and hear her case as previously scheduled. In support, Ms. Cordoba states:
1. That Counsel Choate contacted AUSA Klump but does not know if she objects.
2. That Ms Cordoba seeks a severance from the other defendants because she objects to a continuance and wishes to go to trial as scheduled. More importantly, Ms. Cordoba intends to assert that she was coerced and acted under duress from the actions of other defendants in this matter and is afraid to testify as to her defense in their presence.
3. That throughout the period of the Indictment and continuing, Ms. Cordoba has been threatened by other persons in this action.
4. That Ms. Cordoba contends that she will receive a fair trial and be allowed to testify freely if she is severed from the other defendants.
5. That Ms. Cordoba asserts that the best interests of justice will therefore be served.
WHEREFORE, the Defendant, by counsel, Belle T. Choate, hereby respectfully moves this Court to GRANT this Motion, and for all other relief just and proper in the premises.
